POPLA appeal for parking on a public road

It should be marked on your deeds, they may have grabbed some of your land.
First job would be that sign photographed and off my fence.
They can send someone to collect it.Be happy...;)0 -
It is quite clear there is no clear boundary to the site which they are attempting to control, nor can you be expected to read that sign and form a contract from where you have parked.
Who does the lawn belong to, is it yours or the housing associations? Who mows it?
It is often difficult to show ownership of fences, they do not always show up in deeds, so don't get too side tracked, the inappropriate position of the signs is a strong point.0 -
The fence definitely isn't on the deeds, we've checked. The lawn is owned and mowed by the council. I agree with your first paragraph, just trying to get the wording about the signage right. I'll post it on here once its completed.IanMSpencer wrote: »It is quite clear there is no clear boundary to the site which they are attempting to control, nor can you be expected to read that sign and form a contract from where you have parked.

Would it be worth sending the photo's I've attached above in with the appeal to POPLA?0 -
bear in mind that the signage only forms part of your appeal, dont forget the no locus/contract/standing and the not a gpeol too0

No it is not, if you buy and pay for a fence and put it on your land, it is your fence.
It is not there for a private company to place an advertisement sign for their business offering contractual parking.
Then take the proverbial by billing him.
It would be down but I would make a point of it, it will most likely be self ticketing by a Norris Cole from the estate who gets a £10 or so each ticket.
I would wait while Saturday morning, step ladders, tool box and cup of tea and start taking it and the other down and wait for Norris to show up, then report him for criminal damage to the fence.
When some takes the proverbial, you do not roll over, you give it back.
As for the Ticket, I would POPLA it as it costs them money.
On the strip of land, it would be quite unusual the house was built exactly on a boundary line, I would find ownership, if it's yours fence it off and park on it.
Who cuts the grass is immaterial.Be happy...;)0 -
One other question related to signage - is it my responsibility to prove that the signs were impossible to read from where I was parked (eg by providing the photos to POPLA that I linked above) or is that UK CPM's responsibility?0

I am not certain where you parked is private land, the council will often say anything just to get rid of you on the phone.
I would research this a lot more carefully.
If it is as they claim then it should have a sign at the entranceBe happy...;)0 -
They've sent me a map with the private land clearly marked in red. Unfortunately I was parked in the red area, but there is absolutely no signage to indicate this as my photos above show.spacey2012 wrote: »I am not certain where you parked is private land, the council will often say anything just to get rid of you on the phone.

Send them an invoice for renting your fence
charge the amount they are demanding, then tell them that you charge £25 a week for use of the fence, billed a month in arrears, but will offer a 40% discount for early repayment
When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.
