POPLA appeal for parking on a public road

I received a letter from UK Car Park Management this morning saying my appeal had been unsuccessful. They gave me a parking ticket for parking on the corner outside my house! Unbelievable really. At the end of the road is a private car park but they are claiming that the corner my car was parked on was an access road.

My updated letter to POPLA is (edit) now on page 3 of this thread - any feedback is appreciated.

    Call the local trading standards and demand they investigate a Scam parking company that is writing fake parking tickets on public roads.
    The police might also be interested as they as in the company directer may be committing fraud by false representation.
    They have been made aware and carry on.
    About as guilty as you could get IMO.

    The problem is that it's UK Car Parking Management, it's not a scam company and it's technically a legitimate ticket. Their argument is that the road is an access road to their private car park, but there is absolutely no signage or anything else to suggest this. It's just a road that leads to their car park.

    Read the newbie threads and cross reference the red parts.

    the council can and will tell you if the road is public or private

    if its public then UKPC will have no authority hence the reference to reporting them

    if it is a private road its private land and so they can issue tickets, but they must adhere to the BPA CoP when doing so

    so if its private land then appeal to popla as per the NEWBIES sticky thread

    your header and post say its a public road , ukpc say its a private road, it cannot be both at the same time, its one or the other

    he has, in section 3 , but I would change the 3) header to include it specifically

    I would also put numbered bullet points before the main body of the appeal too

    you wont lose at popla providing you use a forum aided appeal, and you have bad signage , no contract and not a gpeol listed

    the main thing to check before sending this in is with the council to see if that road is public or private in its ownership, should be easy enough to sort out with their highways dept

    if there are no signs then its a slam dunk really, never mind the 3 main appeal points above

    How is it obvious its a public road? Have you got confirmation from the council on that? I am sorry but unless you have proof you should not add it to the popla appeal, a public road would not be relevant land, that is how you phrase that. But you can only go for that if you have the proof. Not that popla will go for it, they will jump on the pre estimate of loss
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.
