    No I do not work for apple!:rotfl:

    I had a few friends who placed an order for the Iomage and they asked me to look into this for them.

    From what I can see that there was no contract of sale between Apple and their customers as there was no order confirmation sent out by them for the Iomega. The order confirmation sent by Apple is when they agree to give you the product for the price on the Store.

    Why take people's money if they've not agreed to sell you the product? Like yer man above says, they couldn't do it in a high street store but can get away with it online.

    Then why did apple change the orders BEFORE informing the customer?

    I dont feel its as clean cut as being no contract, if i was in apples shoes and knew for certain there was no legal obligation i would have informed the customer of the error as soon as it had been realised then taken it upon myself to change the orders to canceled.

    I would see no need to doctor the status page and alter the initial product to another item.

    I would also add on my terms of service that the payment procedure is automated and is in no way legaly binding, they seem to have omited this crucial detail.

    From what i can see theyve breached their own Terms of Service, by misleading the consumer and intentionaly withholding relevent communication in what i can only see as an ostrich in the sand tactic, hoping that it would all go away.

    If apple had been as certain of their legal position as you seem to be then none of this would have taken place, as soon as the item got taken off sale there would have been an automated email to each individual stating the error.

    They HAVNT taken your money, it's just how the banks display it to you! Read my posts from before!

    Again, I posted a clause on there payment - They havnt taken payment, they have simply pre-authed it.

    It seems there terms and conditions are sufficiant to protect them, how they represent themselves regarding this issue is a matter of there own. If they act like idiots then its only there own reputation to suffer.

    Sara_k, excuse me for being doubtful, but shouldn't someone in your profession be able to spell lawyer, legal and legally?

    It might help your career somewhat. ;)

    So they changed the orders to a print label and then canceled it.

    At no point did they cancel the drive and I have not agreed to have the drive canceled.

    Mindware. PLEASE realize that they HAVE taken money from anyone who has paid via debit card.

    Avaliable balance on my account currently is £1478.00 My balance is currently £1478.00. My statement currently states £1478.00

    On 2nd July, Apple took the amount. If they hadn't, my available, statement and normal balance would all be higher.

    THEY HAVE TAKEN the money!!! Maybe not for credit cards, but for debit cars, they deffo have.

    Regardless, they have still broken T&C's which states categorically, they take money on raise of invoice or shipping. ALL shops I use on the internet take money when the item has dispatched. They normally send an e-mail and then take the money. Dell do this, and still honour misprices.

    The only 2 misprices I have had from Dell, they always take longer. One was for 2 monitors priced at 30% of the inital value. Took 3 weeks to recieve them, but I did. It was 3 weeks after the initial purchase that they took the money. It was the same on a computer misprice.

    Another place I use often takes part payment as they only have part of the order in stock. Amazon also do this, or dont take the money until the item is ready.

    I have never seen this automated process. Thats just me though.

    Out of all the other misprices I have tried my luck on, i have NEVER been charged. Thats fair enough. I have done at least 100 of them. Did a HMV one just a couple of weeks ago, they sent an e-mail saying there was a mistake, paid by debit card that time, nothing was taken.

    If I go into tesco, pay for my goods with £50 cash and walk out, does it mean that I havent actually paid for those goods because they have not physically banked my 50 notes?! No, it doesnt. I have paid. Its not yet hit their accounts but my wallet is £50 lighter.

    I have read your posts but I have also ordered things from other companies who have emailed me straight away to say as soon as my item has been despatched they will take the money from my account (this can sometimes take a few days), why could Apple not do that? As far as I'm concerned they agreed to sell me the item as soon as they 'took' the money. I did not agree to lend them any money so they should not have taken it.
