Having had a glance through the last few pages of this thread, I take it you are legally entitled to defer, have sent off all the legally required evidence, yet they are refusing to defer you because you won't sign their change of terms and conditions aka their DAF?

    That is correct.

Note the offer of settlement on the letter though, offer them twice as much as they paid for your loans.

Apologies, off topic but anyone aware of when the deferment level for this coming academic year will be announced?
Erudio have nothing on the site and I'm not sure what Govt. department mortgage style loans sit under now there has been a change in structures.

So this year no-one has been deferred without signing up to their change of terms and conditions?
I made the same changes to the t&c's (removing some of theirs and adding my own) as last year JeLaw, deferment went through fine. I know some others who amended the t&c's and were deferred, but some have been refused for making amendments. So nothing much has changed there, Erudio are still being as inconsistent as ever!

It should be any day now. I had a quick look at the figures, and worked out the new deferment level as being £29,126. May be slightly out (around £100), as BIS didn't round the AWE (Average Weekly Earnings) figures last year when they should have done, so may revert back to doing that. Also, the AWE figures aren't showing as revised, whereas in previous years' publications, they've always been revised by July time. The new publication's out tomorrow, so I'll check it then to see if the AWE figures have changed.

The Department for Education now has responsibility for Higher Education. It was DfE who responded last week (well, their Barrister did, on their behalf!) to the appeal I have with the Information Tribunal, re the withheld info in the Sale & Purchase agreement.

New deferment threshold will be £29,126, and RPI interest rate is 1.6%:

Exactly as you predicted. I am impressed.
Not many, but at least someone paying this year wont have to pay them next time round.

Had a letter yesterday saying that the loan had been terminated and the balance due in full.

Funny that as last month I was told they'd already passed my details on the preferred dca. They are just a shambles.

I'm not bothering to reply, no point.

Thanks for this. I think I am a couple of weeks behind you in the queue.
  • Three weeks passed.
I've had no response from my letter to Mark Filer, nor from the copy which I sent to the mfiler email address. I was asking for the name of the person legally responsible for (mal)administering my account, if it wasn't Mark Filer. I also asked about FCA regulation of KGS Associates, and other partners in data sharing.

So now I'm drawing up a Subject Access Request, with a ten quid postal order. The scope of SAR obligations includes disclosure of those with whom data is shared, and also "the logic involved in any automated decisions".

Has anyone here made a Subject Access Request of Erudio?
