    Another observation regarding the 'Sale and Purchase Agreement':

    I recognise that the deferment clauses are a comma flavoured semi-colon fudge of about 290 words, with a single cherry of a full stop. Even worse than my writing.
    However:
    "9.3.4.B process each deferment application and

    (2) if no further information is required
    ...

    or if further information is
    required, within 21 Business Days of receipt of all such further
    information (or fully completed application with all necessary
    verification and evidence requirements satisfied) notify (i) the
    Borrower ..."

    In the event that Erudio are not asking for more information, and considering any time limits specified elsewhere for submission of applications (not DAFs), then Erudio are hanging on the clause
    " all necessary verification and evidence requirements satisfied".

    In cases where Erudio are not disputing that an application has been made by the loan holder in question, then "evidence" = what has been provided, and "verification" = what ?

    So if we write to erudio, it actually goes to KGS, who then scan it and send it to Capquest in Glasgow?

    Is KGS FCA regulated?

    I wrote to Mark Filer, asking him to confirm that the people whom signed for my letters did in fact work for him. I asked which other companies he was sharing my data with. I also asked him if KGS Associates were FCA regulated, amongst other relevant 'conversation'.

    I just searched the Financial Services Register, and drew blank for KGS Associates. There were a few entries for KGS, mostly initials of people, one for KGS Financial Advisers Ltd., Ipswich... initials of person in a different line of work.

    Anyone have a link to a pdf of the current deferment application form? I think it's supposed to have 'DAF AP02' printed at the bottom of it?

    Not got a link but just checked the one they sent me this year and it's not got DAF AP02 at the bottom.

    Erudio's website says the current form has that printed at the bottom of it. Introduced end of February apparently, not sure if that's 2015 or 2016 though.

    Guessing no updates on the whole Erudio nightmare?

    Has anyone managed to get a deferral without signing their DAF aka agreeing to a change in terms and conditions? I managed to defer past couple of years using an amended version.

    Do I have to resign myself this year to a stressful fight/legal action rather than signing?

    Sorry for not being present here more often - and helping to keep up the fight. Kept meaning to check in here but have had too much else going on..

    Depressingly from the flick through last few posts it seems nothing much has changed - certainly not for the better!

    Had a letter yesterday saying that the loan had been terminated and the balance due in full.

    Funny that as last month I was told they'd already passed my details on the preferred dca. They are just a shambles.

    I'm not bothering to reply, no point.

    Having had a glance through the last few pages of this thread, I take it you are legally entitled to defer, have sent off all the legally required evidence, yet they are refusing to defer you because you won't sign their change of terms and conditions aka their DAF?

    So this year no-one has been deferred without signing up to their change of terms and conditions?
