    How odd. After getting a swift deferral, I have just received some of my evidence (CTC award) back in the post sent 1st class signed for!

    It was obviously a photocopy which I did not need or expect back and only made up part of the evidence I sent them.

    My original deadline was May 19th. I was told courtesy of the Important Notice that my deadline had changed. I'm still waiting to hear from them.

    They received my complaint letter 5th May.

    Same old, same old...
  • But what's this? A letter!

    -It is dated 09/05 on the print code, 10/05 on the letter, and arrives today on 13/05.

    -It doesn't reply to any of the questions I asked in my letter dated 04/05 received by Erudio on 05/05.

    -It does however extend my deferment date to 19/6 from 19/5. This gives me a total of 37 days from notice of the new date to get the forms done.

    So it really boils down to this:

    -my DAF received on 14/4 was three weeks late and left me 35 days to apply before the deferment deadline. This to Erudio is bad service.

    Erudio granting me a longer deferment deadline and informing me of this on 13/05, thus leaving me 37 days to apply before the deadline is considered acceptable service

    -Erudio's original claim at the start of April was that they hadn't sent out all the correct paperwork. If this were true and not simply PR vomit, then they have failed to send me the correct paperwork. Their lie doesn't stand up to the mildest of scrutiny.

    I wonder when I shall get a reply.

    A very disturbing recent FOS decision. Seems Erudio will try anything to stop a borrower deferring. Even the Ombudsman seems taken aback:

    If the ombudsman seems taken aback, then she's the only one.

    Making it hard/impossible for borrowers to defer their loans has been an everyday Erudio tactic from the minute the government sold them the loans at a massive discount.

    Seems that Erudio are still as incompetent as ever as this thread seems to grow and grow!
    I've just had a letter from them and I'm keen to see if they're playing fast and loose with the truth again.....
    Does anyone have a copy of the Terms and Conditions for their loan around 97/98? The only paperwork I have from that time is headed up Credit Agreement Regulated by Consumer Credit Act 1974...... I'm unsure if its the same thing and rather suspect that it isn't......
    All I'm looking for is whether I agreed that the loan company (SLC/Erudio) can share information with third parties and what the wording is around these clauses.

  • I am not aware of anything in the regulations or contracts we signed that stated information could be shared with third parties. I know its a massive search but this has been covered in detail at various points in this thread. Upshot is SLC asked for permission to share information with third parties each and every time you applied to defer. Same as ESL. If they had these rights already they would not ask for your agreement each time.

  • That's kind of what I'm thinking.....

    I've done a search through the forum to see if there are any terms and conditions posted here but all I've found are posts talking about the legislation being the terms. For some reason I've not been able to find the legislation again despite looking! I must be doing something wrong as I've seen it previously (if anyone can post a link or PM me the details it would be massively appreciated!)

    I did end up complaining to Erudio and then on to the FOS who sided with me (shock horror) and told Erudio to wipe the arrears they'd put on my account off and compensate me...... All of this was achieved by an adjudicator which made me impressed, and seems to be contary to most people's experience here. The only downside was that I'm still waiting for Erudio to actually honour their side of the agreement. No surprises there though.

    Hi, just thought that I'd let you know that this years' deferment has been approved with just the one bank statement. Yesterday this years deferment pack arrived in the post, only 18 days before deferment date end, so good job I'd kept a blank copy of last years. I rang them again yesterday to check if I was wasting my time with the one bank statement I had returned with the form to be told that deferral has been approved for this year. It seems like asking for three statements was changing the T&C's a bit too much! Who knows what will happen next year!
