  • I just found this in the FAQs section of Erudio's website (http://www.erudiostudentloans.co.uk/faqs/default.aspx), and I have to say it sounds very dodgy. @erudioed I think this ought to be highlighted. Also, Erudio have done so many things wrong recently, that I still hope there's an article about them in the mainstream press:

    "If I return my form by the original deferment deadline, will my maturity date still be extended?
    No. For customers who are able to return their deferment forms by their original deadlines, their loan account will continue as normal.

    However, for customers who are unable to return the forms by the original deadline, their deferment period and maturity date will be extended to ensure they are placed in the same financial position they were previously.
    "

    As they are the ones who have messed up, they certainly should automatically be sending us letters stating revised dates (giving us at least 56 days to get our forms back) for the end of our current deferment periods. The statement in the FAQs section of their website makes it sound as if the onus is on us, plus, even if we do return the forms 'by the end date of our current deferment periods' there is no guarantee that our forms will have been processed and approved by the time our current deferment periods end. If we haven't been given approval by then, Erudio will immediately try to take money the day after!
  • The website and online portal are not trustworthy while Erudio have to qualify this...

    I agree, anyone impacted with a late DAF should have in writing from Erudio their line on what has gone on and what they intend to do about it. Its all good evidence!

  • @BorderReiver What are you going to do if Erudio don't confirm in writing new dates for the end of our current deferment periods? I want to get my DAF sent off soon, but I'm concerned that, if I send it off now, they will say mine isn't extended because I returned the form in time. However, as I said in my previous post, that doesn't mean they will get the form processed in time for me not to be expected to pay the loan back the day after my current deferment period ends. I think the way they are going about this is very underhand.

    Since being contacted by MoneySavingExpert.com, Erudio has said it will be mailing missing forms out and has agreed to extend the deadline to apply for a deferment by 56 days.

    I say hold Erudio to it. If they don't you can go to FOS, and include the article with your complaint.

    I should perhaps mention regarding my CRA post earlier that all my loans are post-98 MS loans. Although Erudio did sound like they were talking in very general terms in the statement, it is probably worth getting MSE to clarify what is happening.
  • If you really need to get in a full DAF (fill out in full and add your signature to the certificate and warranty they provide) you can get one from me... They email them to me on a regular basis although quite bizarre, ESL seem unhappy to receive deferments via email? Also their online portal? Who knows what terms and conditions they have yet to conjure up or twist?

    They may process your application on time and either way, if found at fault (and it looks like they clearly are) you can reclaim any payments they take if you are paying via DD. If they wrongfully put you in arrears you get them wiped and claim redress.

    You could also put in a bespoke DAF, altered or as you see fit? You would still be covering your obligations by sticking to the regulations and terms and conditions because in reality what matters is that you 'show' your gross income? Although ESL are hung up on signatures they seem to think don't alter what our terms and conditions are. They would again at this point put you in arrears.

    I am not in the same boat as you at present as my deferment was due some time ago and they have refused to accept my form.

    My previous post is just agreeing with you. If you have fired off a complaint then Erudio should put in writing exactly what has gone on and what they intend doing about it. In writing. No dispute as to what their position is. If people decided to take it further you have evidence. That is what I would be asking them to do.

    Ideally a full statement to the press too! In black and white for the record. Anyone impacted with this DAF fiasco, gaining as much clarity from Erudio is essential. Statements on their website are just not good enough.

    I can confirm several of my annual statements have missing information and may not comply with section 77A of CCA2006.

  • Thanks for that, BorderReiver. As I finally received a DAF in the post from Erudio the other day, my main concern now is them apparently dodging out of confirming new deferment period end dates in writing. Until they confirm this, I don't trust them not to try taking payments as soon as the current deferment period ends if they haven't had time to process my form yet (which is quite likely, as there are 7000 of us in this position).
