    I think i might c&p that to the FCA too if you don't mind. A class-action suit might be the way to go over this after all.

  • Great work Anna. I am shocked yet delighted in equal measure as I was sure a great deal of the documents would be deleted/censored before they reached our hands.
    I look forward to reading this in more detail and contacting the FCA and FOS etc with my complaint.

    I have a letter from Greg Clark MP who was minister for universities, science & cities (weird combination) which states "the T&Cs of MS student loans have not changed as a result of the sale of these loans to Erudio, & borrowers have the same rights & obligations as they had when the loans were managed by the SLC."

    Also have one from Mick Laverty, chief executive of SLC stressing that "the transfer of ownership [to Erudio] does not affect the T&Cs under which [my] finance was borrowed"

    So who is telling the truth :wall:

    I'm going to try & read it over the weekend & formulate a letter too the FCA & copy FOS in. Really disgusted from what I've skimmed through so far :(

    I've had a reply from Erudio about the complaint that they opened for me without being asked. Surprise surprise, they can't uphold it! They've flat out stated they will not accept an amended DAF and that anyone that has been successful using it was a mistake. They've also stated that as my original deferment application didn't use their DAF then it doesn't count for the purposes of which is the active month for deferment calculations.

    A quick search on the internet reveals a great deal. Apart from all our letters from Erudio, FOS, MPs etc stating original t&c are not changed as a result of the sale there are plenty of public news reports with quotes as well.

    Up until now, we were fighting on the basis on interpretation of what the original t&c meant, especially ambiguous points such as clause 16 for CRA. This though opens a new tin of worms altogether and a massive shift of the goal posts. Raises many issues such as our rights to give informed consent.

    I for one can't wait for the FOS to try their sh&^e with me again!
