@ Brooker Dave It is the Parliamentary Ombudsman for complaints against Ministerial Departments, and has to be done via your MP.

So the first step would be for each of us who wants to take it to the PO to contact our MPs, pass them a copy of the S&P agreement, which should help raise awareness of it - might be an idea to send it to Jeremy Corbyn too (I'm sending a copy to the Scottish Government as well).

After that, we could make a joint complaint to the PO (although I would have thought the PO would group a number of similar complaints together anyway). Does anyone have a high profile MP who would be good at taking the complaint forward?

I've resurrected an old FOI request for BIS's due diligence report for the sale of our loans to Erudio (I stupidly left it too late first time, as it has to be raised with the ICO within 3 months following the internal review). Details here:

    https://www.whatdotheyknow.com/request/details_of_the_due_diligence_pro_3
  • Nice one, BIS need to be made to pay for selling us out like this.

The part where the contract allows profit to be put before our rights, just because someone working out of a tax haven wants to make a quick buck damms them.

The BIS seems to have forgotten who they are supposed to be working for...
    "Love you Dave Brooker! x"

"i sent a letter headded sales of god act 1979"
  • That FOI request is brilliantly written Anna, you really do get a sense of the importance of it from how you have written it.

Excellent work Anna. Will be very interesting to see how that foi works out.
Just wanted to share with everyone that I have accepted a binding FOS decision with this wee gem in it...
"I can understand why Mr BorderReiver didn't want to allow Erudio to report information on his loans to credit reference agencies. But they have accepted this was not part of the terms and conditions of all his original loans."

While they failed to consider any points about using a DAF they state that Erudio must accept my DAF 'corrected' or else one that is unsigned.

Also remember you can request your case file from the FOS.

Battle lines drawn... Not sure I can see how Erudio will squirm out of this in a court case!

In the meantime I will busy myself with writing to the CRAs, FCA and my MP.

This is a great FOS decision and will personally come in very helpful for me in the future. I sent an amended DAF and was accepted ('in error' apparently!) and was worried about what a fight I might have to have next year.

    Great work!

No problem at all. If I can help in anyway just pm me.

Was this for the pre-1998 loans Erudio stated this about or post-98?

@ginoclock: Thats a great FOI request. Its really probing the creation of the DAF and BIS' role. How could BIS allow that 1st DAF with those questions about home ownership and personal info, not to mention the threat of CRAs in both the 1st and 2nd one. Also, how could BIS allow that first form we all got with the threatening CRA stuff and actually asking if we would mind our post 98 loans being reported. BIS is supposed to be our representatives and this FOI, if it is upheld (and i cant see any reason why it wouldnt be as it would only be showing what the debated issues have been), will illuminate just how much BIS went into bat for us. I think most of us already know the answer to that, but this is a chance for BIS to be transparent and give us something concrete. Lets face it, apart from saying T&Cs wont be affected, they have said absolutely nothing on the record about this loan sale and where it stands, nor shown how it has represented us ex-students.This great FOI request will give them that chance!
