    According to the department of Business, Innovation & Skills (BIS), the 25 years starts on the date the 1st instalment of you final mortgage style loan was paid to you.

    Response from BIS to someone earlier this year.

  • I still haven't received anything in writing about the rejection of a settlement. Despite being told several times that I would get a letter.

    The FOS are still waiting for a response from erudio - that's now over a month.

    I don't know what to do. Do I now try to defer and go through the drama with the DAF? Pay them the full whack despite me knowing it's a con? Or just decide to stop all communication with them and see if they start trying to send the bailiffs round? Or try to take me to court?

    If they don't do what I expect of them, why should I do what's expected of me?

    I wouldn't just ignore this company as they are professionals when it comes to debt, so they really won't play nice.

    How do you feel about deferring with an altered DAF?

    Personally, I have been marking this form, in pen, with 'I do not accept any changes to the original T&Cs' along with my signature and date. Would this be acceptable to you?

    I have read of other people crossing out sections that they weren't happy with, so this is another option?

    Or do both of these steps?

    I deferred in the first year by supplying a letter and crossing out all of the extra elements of the DAF that were additional to the SLC forms. I said clearly I did not consent to the collection of data beyond three months' payslips. There was a template somebody provided on here so I went with that and eventually after a lot of arsing about, it got deferred.

    The issue I have is deferring is just delaying dealing with them for another year when the reality is I would have to keep dealing with them for the next 14 years if I want to defer until it gets written off or another 5 years if I continue to pay them. Basically, I don't want to deal with them at all. I'm sick of the phone calls, the letters, the endless arguments on the phone. I just want to wash my hands of them.

    It's a rock and a hard place situation really. If I pay up they are potentially getting money they are not entitled to (I've never received a statement), if I keep deferring then I still have to deal with them. It's a no win situation.

    If you are desperate to wash your hands of them, then could you continuously try upping your settlement, via email, until you both have negotiated a final amount?

    When I was offering a settlement, I found that Erudio was reasonably quick to get back to me via email. So, maybe this is a less stressful way to deal with them? (If you haven't done this already, of course.)

    Whatever you do, I wish you the very best with it. :)

    Which email address did you contact them through? I rarely if ever get a response via email.

    CustomerService@ErudioStudentLoans.co.uk

    In case you don't know, you will need to put your name, address, DOB, and relevant references on every email you send.

    Surely provided we keep up with our commitments under the agreement, then Arrow can just whistle?

    How would they win in court if it can be easily shown that that we kept up with our side of the agreement, but Arrow just ignored theirs?

    Will they dare take anyone to court?
