    You may also have to complain about any arrears that have built up, but if you did not follow up the lack of forms you might not have much luck with that.

  • Interestingly I've just got home to find a letter from Erudio telling me I am due £100 compensation for the terrible service I received. I did also complain to them about threats to my credit file and part of the letter says:

    "I would like to take this opportunity to assure you we are not currently reporting any information to credit reference agencies."

    Which begs the question - will they if I settle? They have written that they are expecting my offer of settlement as I said I was considering it but it does seem very interesting they've been so quick to give me £100 before I've gone to the Ombudsman because I did threaten them with it on the call this complaint refers to.
  • Not sure what they are playing at but they normally don't give a ...if you go to the FOS. I suspect they just hope you follow up with a settlement offer.

  • If all they want is some of their money back I'm gladly going to give it to them. I won't joyfully give them 100% but I will settle if it stops me having to deal with them any longer. Ultimately if they are a DCA, making some sort of profit is all they're really interested in.
  • They are only interested in getting a return. However I suspect that they know full well that legally they cannot touch peoples credit files. They will never admit it because they want people to think they have this right to scare people in to paying up.

    If you gave them 100% then it would be of benefit to you if they marked your CRA accounts... the issue as you know is if it is a partial settlement/amount. You need to have some sort of written evidence from them as Fermi suggested.

    I had to give this all a break for a few weeks as it was just getting too much.

    Someone posted earlier that Erudio had left search footprints on their credit file. I know that some folk complied with the DAF, some crossed out the 'consent to credit checks page,etc' and a few were deferred with no form at all.

    I would like to know, for those who crossed out the bad stuff on the form and wrote they do not consent, has anyone seen credit check footprints on their file?

    It be useful to know whether they are treating you any different if you have not signed the consent.

  • I crossed our everything on the DAF last year and wrote "do not consent" all over it. I didn't sign it and gave them three months' payslips. Nothing is showing on my credit file. Recently there were a bunch of searches but I was getting car insurance quotes at the time so imagine that's why. Other than that they haven't done anything with my credit file and claim they aren't going to in my recent letter from them.

    I had a search done on my Noddle account only despite crossing through all the consent stuff and writing do not agree. That was last year. I haven't seen anything this year yet. I was deferred a few weeks ago. I have screenshotted the page but don't know how to post it.

    Thanks for the info. A small sample is not a lot to go on but it's sad to hear confirmation that your crossing out was ignored. I wonder why they are credit checking som people but not others?

    Loans taken for academic year starting in 1997 are either on the new type of agreement post 1998 (disclosure clause 12) or the older type (clause 16) pre-1998.

    It depends how late you took the loans but some borrowers have only the new type where they can disclose your data to CRAs only if you are breaking the agreement.

    Do you know which type you have?

    Has anyone had a credit check when all their loans are on the post 98 type of agreement who has crossed out the consent on the DAF?
