    Hi,

    With so many people having issues I thought I would add my experience.

    I applied for deferment and it went though fine.

    I am sure like most companies they probably get most things done right!

    Though they do sound incompetent when there is any issue. So hopefully if yours is simple it wont be to bad.

    (Just reassurance for anyone that needs it!)

    Still not happy with the entire thing, I think most people would have paid up if offered to pay twice what erudio did.

    Should there be any issues I will keep you updated (I always expect them!).

    "We can confirm with the evidence provided in your letter that your deferment will be accepted upon receipt of your signed Deferment Application Form, you do not need to complete any details other than your name and address on the form.

    Without the form we are unable to upload your details onto the deferment module and run it through the acceptance process. We are unable to manually over-ride this."

    I didn't see anything in the conditions about deferment only being processed if it suits the way their computer works. Your not responsible for the inner workings of their system. I wouldn't accept the refusal to defer because of not using the form.

    However, its nice to hear that they have almost accepted what I assume was a deferral letter.

    Also is that a written quote from Erudio? They didn't ask for a signature on the form.

    The law says you can defer if you are under the threshold and have not already been asked to pay the loan in full because you are behind with payments.

    Using their form is not a legal condition for deferment.

    If they refuse it on those grounds then they are breaching the student loan law and the agreement conditions.

    that was my letter which I posted to the mumsnet thread but have also been following this one.

    Yes, direct quote. They have included a form to return and attached is a post-it note with the words:

    "please complete name & address section , sign and return"


    Oh and I won't be signing their form. They have already agreed to my eligibility and they have no DD set up for me. I will write back and complain about their refusal to allow a valid referral due to 'alleged' inadequacies of their IT systems and threaten with FOS.

    As I didn't actually get my application pack until the last minute, I was advised by erudio on phone to scan my documents and send them via email. I didn't get requested confirmation of receipt and when I phoned again to find out and tell them I was worriedabout money being taken out of my account, they said that this wouldn't happen as they didn't have my DD details anyway! I eventually got an email reply saying that they received my email but cannot retrieve my account details and therefore need my name and DOB in order to do so. I'm not sure what to do. I could possibly resend the information by post with covering letter minus the form.

    Heartbroken - shame about the post it, doubt its documented that a scribbled post it note was included though... Anyway.

    I think your letters a real breakthrough, big thanks for posting it.

    You probably don't need to, and I think your right to insist they defer you without the form, but might be worth considering signing after crossing out the CRA bit?

    Will see how I get on with my latest letter which I'll send tomorrow which basically says what Fermi states above. They should not be using the form as a reason for denying a valid deferment.
  • I've emailed them, phoned them and written to them and heard nothing back. All I know is they took a dd out of my account last week and I have never received anything from them saying how much I owe, or how much my monthly repayments will be. I think its really bad that a company can seem to change rules when it was written they wouldn't be when they brought the loans. I dont know if they're going to force there way into my house and demand money I don't have at the moment and it scares me as someone living alone.

    I echo Rosskie's thanks. I'll be following your updates with interest. Gives me an idea of what to expect and what to do come September when my deferral is up for renewal.
