Perhaps I shouldn't have said crazy and weak. I feel that people are quite understandably worn down after many months of hassle and just want their loans deferred. My intention is to encourage people to be strong and not give one inch when it comes to their rights.
None of this is the fault of borrowers so I do not mean to criticize anyone. It is understandable that not very many people want to go through the inordinate lengths required to get this issue dealt with once and for all.
Ammending the form is better than nothing because you can say you did not agree, but it will not stop them carrying out changes they want to impose. There will be more each year and every year people will say they do not agree, but it will not stop.
It is a choice for everyone and not for me to criticize. Unfortunately, it's a choice between two bad things that have been forced upon borrowers through no fault of their own. (Choose between the hassle of fighting or lose your rights and be hassled year after year).
People have tried to stand up for themselves using various watchdogs but have been let down
The fight option looks harder in the short term. They know that and will calculate what they can get away with. What we have seen so far is the thin end of the wedge.
No one should feel pressured to send back a form that could affect their rights.

Does anyone know what the stance is on loans being written off? I took mine out end of 95-98 and was 27 when I went to uni- I'll be 50 in 2018 and under the old SLC terms my loan should have been written off- what now? I had cancelled my DD with the SLC as I was nowhere near the threshold but realise that this is technically a breach of contract and they could have refused to write off the loan, I have since Erudio took over left the DD there, in case they try and catch folk out who get the runaround during trying to defer and cancel their DD's...
I'm getting the same runaround but been phoning and emailing and as of yesterday have been told I have had 2 packs sent out (14th and 25th)....
I'm just glad I googled the threshold back in NOV and got a shock...what a scam and a shock to many no doubt. Thankfully my boss is understanding and I've declined any O/T or taken TOIL back when needed- I've missed the threshold by £400...might even contact my MD after Septembers announcement (not holding my breath this will rise significantly, if at all- ok for £150k+ bankers to line their pockets at our expense) and ask for a pay freeze, we've been getting 3% a year....Mortgage is due to be paid off by 2020 so I'm downshifting workwise anyway....these FFFFFers will never get a penny back from me...my loans must be dated to the time when they needed my consent to sell/transfer??

Whether you have a DD in place or not is arguably not a breach of the agreement if you are deferred.
Anyway, the issue with a DD does not matter for the purposes of qualifying.
The law in the Student Loan Regulations is very clear.
The can only refuse you the age related write off if you:
"behind on any repayments under any agreement for a student loan"

That seems more than reasonable to me, given that the DAF's not a requirement at all. I don't have a problem completing the parts of the DAF on income, as that's the information they need to process the deferment. But they won't be getting my agreement to their information processing, or my signature on the DAF.0 -
slightly off the current discussion but i've pretty much only just found out about the threshold being reduced.
i earn £5 over the gross monthly income threshold, so less than the repayment threshold from 3 years ago.
I have been deferring repayment since 2000 as I have never earned a salary that was over the threshold. In each of the previous years since then, the threshold has gone up slightly so I never thought I was in danger of reaching it anytime soon (especially with no pay rises due in the near future at least). Now that it has gone down substantially for 2015/16 I have hit the threshold – as i said, I’m over by £5 per month. So from April this year, I will have to find £150 per month, which is the amount my repayments have been fixed at, which I have not budgeted for. I don’t see how I will be able to afford it..,. Is this something I can challenge?0 -
I was thinking of completing pages 1-5 of Erudio's new DAF (only the necessary bits), and move the certificate and warranty (excluding sections 9d & e) to a covering letter?

Yes you SHOW your income on pages 1-5. Send a cover letter with a declaration and SIGNATURE BUT DO NOT SIGN the actual DAF. You have met the original conditions of the loan agreement. Repeat until your 25/50 years is up.0 -
Ok - stupid question time - is there no contractual or legal requirement at all governing when Erudio send the DAF? Is the timing of despatch of the form at their discretion entirely?
Received 2 DAFs in the post - hooray:rotfl:
One seems to have been generated by my contacting Erudio and the other (diiferent return address on envelope) looks like it was the original DAF sent by snail mail about two weeks ago and more than a week after my 8 week submission anniversary.

Hi all,
I've been following the various Erudio threads getting worried about deferment and worried about what I'd have to send them. I was getting ready to phone them as i was due to get a deferment form by 10th of the month and it hadnn't arrived..........then a couple of days ago I got a letter from the Student loans company with the usual deferment form! No change to the form - not from Erudio directly - but i don't understand why? I obviously feel lucky and hope i therefore won't have any problems - but the letter talks about my two loans - one with Honours student loans and one with Erudio. Yet it looks like as i've done for every other year - i can use the SLC form to defer both of them.
Has anyone else had this?
Should i therefore relax a bit or could Erudio still start sending me demands for other things or reject my claim for deferment ? (I'm £100 or so within the limit of earnings so i know it should be fine)

Yes, if you have some loans with Erudio and others with Honours or Thesis, then SLC carry on doing the deferments for both sets.Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB
