Considering how long it takes for FOS to resolve complaints, I'd be surprised if it reaches the required 30 cases for the data to be reported.

well the fos adjudicator has taken three weeks to com back with the same reply. which part of they has miscalculated by adding child care vouchers rather than just using my gross pay does she not understand. im frankly peed off and know im gonna get stung for the arrears as its taken them ten months to get here.

and this paragraph had me seething in her email .

It is useful to point out that Erudio is entitled to make its own commercial decisions about how its firm is run and the procedures that it chooses to operate, within regulatory constraints. As such, it would not be appropriate for our service to intervene on any commercial decisions like this – especially given that Erudio is acting in line with regulation. On this basis, I am unable to conclude that Erudio has acted unfairly or unreasonably in this instance.

Don't waste your time with this, just use the courts to enforce your contract.

I know I probly won't be entitled to deferment but shouldn't a simple calculation be the thing they get right.

In the UK we have "soft touch" regulation, so expecting regulators to help is a waste of time.

However we do have contracts and courts, and with the help of Tony Reeves anyone who has genuinely been wronged by Erudio can use the courts to put things right.

So after about 20 phone calls and numerous emails I finally managed to get them to accept that my loan was still in deferment from the studio loans company and to stop demanding payment from me.

However my time is now up , my current deferment runs out on the 24th January and I am currently unemployed, so what is the general consensus regarding filling their forms in ?

I really am apprehensive about putting my bank details on there after hearing stories of them taking payments anyway but I also don`t want them to claim that as a reason for default and make me repay the whole lot.

So without having to trawl through 100 pages of this thread, what is the general opinion at the moment regarding filling these forms in ?

Any help would be greatly appreciated, thanks.

Seems court action or the threat of it is the way to go. A ballache I know but Proves Erudio are just bullies and trying it on. They back down when a lawyer gets on their case :)

Judging by FOS responses being posted it seems they will be little or no help: which is a disgrace but not unexpected.

For a quiet life I would fill in the form with the same info you gave SLC in the past. Cross out all the FPN and CRA threats And send a cover letter saying you are in no way accepting any new conditions!! Use recorded mail!! And email them too as back up!

You do not need to set up a DD if you are in deferment and Anna on here has that in writing from erudio!!
