I've had a response from SLC to the FOI request where I picked up some of Mr Wild' refused requests, they initially refused mine too on cost grounds, but have answered most now at Appendix 1 of their latest response here:

Some interesting info there, something that struck me was the number of deferment applications processed by SLC (although the way the stats are presented is confusing).
Would also be interested to see SLC's comments on Erudio's draft DAF!0 -

Just reported them to the Ombudsman too. Hopefully they're accruing a very thick file on them0

Finally after waiting for ten weeks for Erudio to answer my complaint I have had........ NO REPLY!!!!
So, I have a small amount of time available to write complaint letters.
Would the Ombudsman or FCA be the better one to do first??
Also, and I apologise if I'm covering old ground here, I searched the Intrim Permission Consumer Credit Register and discovered that Erudio were previously known on this register as "Honours Trustee 2 Limited"......0 -
StressedHubby - I would say both. When I spoke to the Ombudsman this morning they were very helpful. They have written to Erudio giving them 8 weeks to respond. I didn't find the FCA so helpful but they did say that anything they receive would be added to a case "if such a one existed". I will be emailing them and reporting the contravention of the DD Guarantee though.0

Just send a copy of your complaint to both! Certainly can't hurt to get more lodged with the FCA.0 -
So in today's post I have received a letter from Erudio confirming that my loans have been deferred. The deferment start date is the 20th November, the day they tried to take payment by DD from my bank account. This is very helpful with regards to the DD Guarantee they so obviously ignored.
When I wrote to them last week about the DD I copied in my local MP, the Dept. for BIS, the FCA and David Willetts MP. This was all clearly marked at the bottom of my letter. I like to think this helped in my case but who knows.
Oh and if this helps anyone, as part of my case they asked for copies of bank statements showing the 3rd party support I receive. I printed off a month's statement and blacked out absolutely everything apart from the credit to my account. They couldn't read any balances or see where payments had gone to, only the information they asked for which was the receipt into the account.
For me at least the stress is hopefully over for another year but good luck to those who are still fighting. My best piece of advice, as so many have pointed out, is not to ever speak to them on the phone or by email. Do everything by post, recorded delivery, and state this fact in a letter to them. If they ring you, tell them you will only deal in writing by mail and hang up.

Wouldn't that be a fairly straightforward thing to challenge? HMRC don't tax these things on turnover, and SLC never took this ridiculous view, so how do Erudio claim to be able to apply this rule? They are in effect claiming expenditure as income, how the hell does that work?
This is exactly the same problem I'm having. I've supplied my tax calculations and copy of documents from HMRC regarding self assessment.
With SLC the figure they used was always total income less allowable expenses which is in basic terms is what your salary would be if you were employed.
Erudio are claiming the figure to use is total income. I have a complaint in about that, rapidly nearing the deadline for a response, so I'll make sure to post what I get back.
Personally I can't see how they can even begin to justify that stance, they're basically saying the way HMRC calculate tax is incorrect!
Learn from the mistakes of others - you won't live long enough to make them all yourself.0
