I'm convinced this is a ploy to push as many people into arrears as possible and then use the usual debt collection scare tactics to get people to pay up.
So long as there is a paper trail and I/we document everything I'm not too worried. If I earnt over the threshold I'd happily pay each month and in fact have done so when I was working full time.
They don't have any phone numbers for me, nor my email address and I stated in the letter that I would only ever deal with them by post - recorded delivery on my side. My 3rd party support put down their address as c/o me because otherwise Erudio will probably associate their address with me as well.0 -

After the stray payments at the beginning of this debacle, and after begrudgingly allowing them my bank details, I have used that '£00.00' set up on my account as an indicator to me that no funny business is going on. Should I see it change to an active payment, I'd be able to try and ask questions before the cash went out.
But if they can take cash outside of a specific amount they've put in place, and that amount still shows on our accounts, then that's bonkers. Rather than £00.00, they might as well just write 'any amount at any time we want when we see fit'.
Yes, that's absolutely correct. On the Direct Debit confirmation I received from them on the 17th October the details show:
Bank account name: me
Day of the month to be debited: 20th
Date of first collection: 20/11/14
Frequency of collection: monthly
Bank account number: 12345678
Bank sort code: 12 -34-56
Amount to be debited: £0.00
So they have directly broken the DD Guarantee by taking out the DD today:
If there are any changes to the amount, date or frequency of your Direct Debit ERUDIO STUDENT LOANS will notify you 14 working days in advance of your account being debited or as otherwise agreed. If you request ERUDIO STUDENT LOANS to collect a payment, confirmation of the amount and date will be given to you at the time of your request.
The bank were great and refused it immediately and offered to cancel the DD but I'm leaving it because it has to be in place for the deferment.0 -

You don't need a DD in place for deferment only if you are in repayment!. Someone, Anna I think, has written confirmation of this from erudio.0 -

Things are only going to get worse until somebody has a victory against them in the courts. I'd bet my right arm that the deferment threshold will be lowered again next year.0

They put that bulls#it in letters all the time but when people challenge it they usually back down and admit its wrong.Still rolling rolling rolling......<

That's ok. If they try and take it 2 months in a row that will give me all the evidence I need to write and inform them I'm cancelling it as they obviously do not adhere to the DD Guarantee.
Presumably I will now receive a computer generated letter informing me the DD hasn't gone through and I'm in arrears, blah blah blah. I'll just write back referring them to the letter I wrote today.
I spoke to the FCA today who said I can send them all my correspondence and they'll keep it on file. They didn't seem particularly interested but I guess they can't comment on individual companies.0 -
