Well I was complaining about the one on the DAF so next year I will be referring to the FOS 'optional' quote and taking out the FPN totally. (I crossed it out this year).
The way I look at it another complaint next year if they mess us about will just cost them more money. Or if they report my 98 loan to CRA - At the moment the FOS are of the opinion that I am not adversely affected as no reporting has yet taken place. I see their point but I am not letting Erudio change anything. It may seem petty to pick up on one loan but so am not starting to slide down a slippery slope , thank you very much!0 -

I have seen that many folks have crossed out the FPN.
The problem is that when the form arrives at the form processing centre, it goes into a machine. The machine is only programmed to collect the answers from each box on the form it is expecting. If you have written anything on the form that the machine has not been programmed to expect, it will be ignored. The machine will register the form automatically and the database will record that the form has been processed successfully. The software will assume you have agreed to the FPN becuase it has not been programmed for any other possibility. Another machine will now spring into life and collect data about you from many sources and process and share your data as if you have consented to the FPN.
This is just me guessing. I do not have any factual information on their internal processes.
Has anyone so far been deferred without the offical form? Has the FOS ever made them accept deferment without the form?0 -
I just got my deferment form and the 'fair'processing notice says;
"we may also share your data in accordance with the terms and conditions set out in the original loan agreement. Those are set out on ourletter to you in January 2014".
I'm really stressed because I never got any letter in January.
Please, if anyone has the letter from January, please PM me/get in touch and let me know what it says or post it here. The letter might be important and I really need to know to prepare my case.
I got an assignement pack in March/April but nothing in January.
Thanks in advance0 -
As far as I am aware, there was no letter in January. The line referring to it is more nonsense or misinformation.
There are differences between the Fair Processing Notice included with the Notice of Assignment and that in the Deferment Application Form, with some additional clauses in the first small print FPN.0 -

I didn't get any such letter about data sharing, & haven't heard that particular letter referred to on this thread before either, but I could be mistaken. I don't know when they should have sent one out to me since my deferral was up in July. When did your last deferment end?
I didn't get as assignment pack either - is this what Erudio also call a welcome pack?
You make some interesting points about machines reading the forms & expecting to have sections crossed out etc. I've no idea about how these forms/machines work but I assumed that if the machine couldn't read the form, it would be rejected & have to be processed by hand. But you could be right....And I find that looking back at you gives a better view, a better view...0 -
I doubt these forms are machine read. If it is a machine I imagine it be like a really old photo copier that a bored admin assistant is hand feeding a single page at a time, the machine jams every third form and the assistant rips the form out and bins it or uses it as fuel for the office basketball tournament...0

Was there not a letter before the erudio deferment pack informing us that we had all been sold down the river? Will check my erudio box file later.0 -

I didn't get one, mentioned that in my complaint to them but they've completely ignored that part.

Thanks for replying.
Pluthero: I received the info pack with the 'notice of assignment', the FAQ, the first 'Fair processing notice' and letter from SLC saying the loans were sold but that was at the end of March. I did not get anything in January.
The other 'Fair processing notice' on the deferment form clearly refers to a letter in January. Please look at the FPN on the deferment form and see what I mean.
ChiefDave: so you spotted it as well but did not get a letter in January?
It may be that there was no letter or it could be that everyone else got one but me, ChiefDave and Gardenia. I'm still worried.
(Gardenia:Seek advice if you did not recieve a 'notice of assignement'. )0 -
I have never read of any such letter on any forum, though yes, the sentence you describe certainly appears in the Deferment Application Form. If you go through Erudio material you will find many alarming and inconsistent statements and much that is false and misleading.
I don’t think you need to worry in particular about the letter in January. I think you can be sure it doesn’t exist. Unfortunately though that is not any real help as Erudio claims the rights it wants and describes in its forms, letters and Fair Processing Notices irrespective of that non-existent letter.0
