    Well, you can count me in on that Anthony, its time to test these barstewards metal. They are not giving an inch, and only a good jab in the ribs seems like it will work. And if we dont do it, then no one will, so it sounds like a small price to pay. Lets hope we can share the costs amongst as many of us as possible!!!


    ME AGAIN NOW: I dont know if it is right to cut and paste like this, but its time i think to see what we can do as a group, or for the group. I would suggest directly mailing him via his MSE email if you want to keep things secret, and because it is most appropriate.

    That's 3 of us so far. Anthony's price is based on around 6 of us sharing court costs to take a test case to court (there may be other options, I'll phone Anthony on Monday to talk it through and post details here)... I really hope we can muster plenty more support than that, what with everything we've been put through with Erudio?

    This would be the only cost, as it's on a no-win-no-fee basis. Remember, we're not committing to anything at this stage and we'd have to sort out the finer details, but it would be good to know how much support there would be for this kind of action, if you're happy to either post up here or PM Anthony?

    hi i was wondering if someone can help me i got a letter from Erudio about them not reciveing my monthly paymnet as they state £0.00 and then it said i am in arrears, and want me to pay £1922.95 ASAP. i know for a fact that they have recived payment as its taken out of my bank every month by standing order £10. im a singel parent with two small children and cant afford any more the student loan was taken out in 1998, i have never had enough money to pay anything and fell behind in payments with the student loan company i come to an agreement with them that i pay £10 which i have been doing is May 2008 the balance then was £2329.01 so it doesn't look like its going down, i phoned Erudio they said they wanted me to pay the full amount i said i cant im on benefits and i have an agreement with the Student loan company to pay ten punds a month that hasnt been broken, they turned round and said cant help you you need to fill in expenditure forms and then we will tell you how much you have to pay otherwise we will hand the debt over to the debt collectors, i todl them to do that as i havent broken my agreement and im not filling in anything, the woman was a real !!!!! and i got nowhere with her, so what can i do, i never agreed to having the student loan company to sell my loan to anyone so why should i pay them the full amount when they didn't pay the full amount in the first place, plus if they brought my loan doesn't that mean that my loan is now paid off by them, i never give them permission to pay my loan off so why should they now want me to pay them money back that they chose to pay towards my loan


    also i recived a annual statement which is the first time i know the loan had been sold, it clearing states that fromm the 1st septemeber 2014 to August 2015 unless im in deferment that i must pay £0.00 on the 10th of every month, down the bottom is a table that its a mortage style loan and that payemnt are for a minimum of 60 months and total credit amount is blank, then says total with NaN what does that mean

    Just about to post form.

    I used a photocopy of the original and removed all the white on black writing at the bottom of page 5 and 6 and replaced it with:


    "I DO NOT agree or consent to ANY changes to the original loan agreement Terms & Conditions or for the recording of any student loan deferment information with any Credit Reference Agency, with the exception of where a formal Notice of Default has been served in accordance with The Consumer Credit Act (1974) and The Education (Student Loans) Regulations (1997).

    The recording of any information with any Credit Reference Agency in relation to the right of deferment under Section 11 (1) of The Education (Student Loans) Regulations (1997) will be constituted as a breach of the original loan agreement, and may result in civil proceedings being brought against Enrudio Student Loans Ltd."

    I got that from another post .... anyway off it goes this afternoon, I'll let you know what happens.

    I think I've read, either here or on the mumsnet forum, of another case similar to your own.
    You see, the problem is, Student Loans Company used to use compassionate measures and, by the sound of it, allowed some unsuccessful deferrers to make payments at low, nominal amounts, such as your £10 per month if they were struggling.
    Erudio is more hard line and is doing things, as it sees it, by the book.
    So, during a period where you'll have been making the £10 payments you've been used to, Erudio has been nicely racking up arrears for you because it sees you as undeferred and you're basically not sticking to the mortgage-style chunks of cash as payments. I imagine it doesn't care about an individual and (as it will be seen - lenient) agreement, made with one particular Student Loans customer.
    I'd maybe lodge an official complaint with Erudio, which should buy you some time. Do this by recorded delivery mail. Never try to sort out stuff like this with Erudio over the phone - their track record for confusion and contradiction by phone is already legendary!
  • the thing is SLC never deferred me, i never graduated only get 790 per month to live on, that looks after my 6year old and 16month old, no extra money, they isnt any spare cash to give to anyone. im paying all the important stuff like council tax electric/gas, school fare, etc there's handy enough to buy nappies and food, and no i dont drink, dont do drugs or smoke,
    how can they say that they didnt receive payment when they take it by standing order every month without fail, im not paying anymore, my children arent going to suffer because of a bunch of idiots that think i owe them money i didnt say go buy my student loan did i
