More global than the SLC anyway, they cover Europe and USA, possibly more.
Are you saying they can't chase foreign students who have returned home and defaulted on their loans? Mr Willetts seemed to think they could... maybe that's why he's gone!
Well they can chase and send letters out. They can even do that with a SB debt until told otherwise.
Depends on the country, some countries it is easier to chase than others but chasing debts across borders costs money. Maybe EU / commonwealth countries might be easier than say Peru/Nepal/Mongolia etc.
British country courts don't have any jurisdiction over foreign residents so there is nothing that can happen to people really (if people have assets in Britain and are coming back in the near future it complicates things)
If they go to the foreign countries court, the court is going to say we don't deal with that here.
They could threaten someone into paying I guess but that is about it.

According to that article ex-students in the USA, China and Japan don't have much to worry about?
How can they get a judgement on someones last know UK address if they told the creditor they moved abroad?0 -
Probably by an application to serve out of jurisdiction according to this https://www.justice.gov.uk/courts/procedure-rules/civil/rules/part06/pd_part06b#7.1
Besides that Arrow use the tactic of sending papers to a previous address all the time. You might be able to challenge that but it could be a PITA.Still rolling rolling rolling......<

The point I was making is that Arrow (and Carval) are much better placed to chase foreign students, or UK nationals who have moved abroad, than the SLC ever was.
The legalities of that, and the situation that defaulters now find themselves in, don't seem too relevant to this thread.0 -

What is a PITA? Can't judgements be set aside? If the debtor can proof to the court the creditor lives abroad and the creditor files papers at a previous address won't the court be angry?0 -

They might be relevant pretty soon (for deferrers living abroad) judging by people being refused deferment and being turned into defaulters by arrow when they are under the threshold.
By the way, what should deferrers living abroad do if they start to have trouble with Arrow, after all it is harder for them to make complaints, take arrow to court (for when they play funny business) etc themselves.
I'm not advocating defaulting, just I can see a situation where legitimate deferrers are turned into defaulters and I guess it is a lot harder for people living abroad to deal with things like that.
Also evidence of diabilities etc is a lot harder to proove abroad when living in a foreign country etc, also what if someone dies everything might be in a foreign language? what if someone is incarcerated? they need a letter from the foreign prison?0 -

@ dizzybuff You can ask the FOS to contact Erudio on your behalf, they can get all collection activity put on hold until your complaint's fully investigated. FOS have done this for others even before an official complaint's been made. If you explain your financial situation, they should be willing to help you out?
Thanks anna Ill follow up a reply today . Im exhausted with all this , they are more of a pain than my ex whom Im divorcing at the moment , after 17 years of deferment I know Im not earning enough to defer even with my benefits.
