    It's getting harder & harder to keep the government in the manner to which they have become accustomed.

    Only time we were landlords we were also tenants so knew what it was like from both sides.

    Got the impression it was very much an amateur sport. If that's the right word. Actually we wanted to be the best landlords, but I expect our tenants would have thought we suffered from delusions of adequacy.

    Well the agent who has taken huge sums of money did the contract and it seems to state pretty clearly 2 months notice each way. We have rent to the 14th April and 6 weeks deposit but of course if the tenant decides to get arsey (not that i think they will, I am sure it is just a misunderstanding, I think they assumed the contract would end unless they renewed it) getting them out will be costly. My feeling is that I try and get a new tenant asap and assuming I can I then return however much of the deposit remains but the main aim must be to treat the tenant fairly.

    I posted this on Facebook last night....background to the story, our two high schools are moving into a brand new building in a couple of weeks time and to celebrate the old buildings, they decided to open the sites to former students so that they could catch up with old friends, relay their memories etc. It was the turn of the other site last night, it was supposed to be the turn of my old high school tonight.

    Due to the events of last night, our night tonight has been cancelled....how could adults behave this way!

    "Can someone please explain how destroying property and ruining things for others is fun.

    Surely as adults, we should realise that with an open evening at a school on a Monday in term time, that there will be students in the school the next day.

    Want to pose with a ciggie in the school toilets? Pose with an unlit one, why a lit one, absolutely no need to have it lit for goodness sake, the effect will be exactly the same.

    Want to trash something? How about trashing your own property, not someone elses, especially in a place of such importance as a school.

    Want to get drunk and mess about? Try in your own garden or house, my memories of school was certainly not getting so drunk I ran amok amongst the classes.

    I just cannot get my head around how so called adults could be so stupid, could have a mindset that this was all good fun...it just beggers belief!"
    We made it! All three boys have graduated, it's been hard work but it shows there is a possibility of a chance of normal (ish) life after a diagnosis (or two) of ASD. It's not been the easiest route but I am so glad I ignored everything and everyone and did my own therapies with them.
    Eldests' EDS diagnosis 4.5.10, mine 13.1.11 eekk - now having fun and games as a wheelchair user.

    Has the AST ended?

    If so and another agreement has not been signed, the tenancy would automatically go into a periodic tenancy, which would require one month notice from the tenant and two months notice from the landlord.

    If the tenancy agreement is about to expire, there is actually no need to give notice to leave on the last day of the agreement but it is a courtesy to do so. If however, they stay just one day after the agreement date, it would then go onto a periodic tenancy with all the notices as outlined above.

    I agree with Sue, if the tenant is leaving at the end of the fixed term, no notice is required as the tenant "is doing what it says on the tin" If the tenant is invoking a break clause then the notice to do so is required as stated in the contract.

    If the tenant leaves, you have a duty to mitigate losses, so can't keep this tenants rent and charge the next one.

    I would say decent behaviour requires you to tell the tenant that the notice they have given is insufficient.

    Unless anything has changed since I was renting in the UK you can simply leave after the 6 months is up if it's a 6 month AST. If it's a 12 month AST with a break clause then the notice period at 6 months is 1 month for a tenant and 2 for the landlord (or less if you're issuing a S21 due to adverse possession).

    Is it 2 months' notice for the tenant to leave during the 6 months of the AST? Otherwise I'm not sure what your agent was doing writing a contract that doesn't seem to acknowledge the tenant's rights under the AST rules as detailed by Sue, silvercar and Generali. You're a nice bloke and I'm sure you do want to treat the tenant fairly, but I think you've been badly advised here.

    If you've got rent up to the 14th April, and that's the end of the contract, then the tenant's not doing anything wrong. By letting you know that they will actually be out of the house sooner than that, they are giving you a bonus opportunity to get into the house sooner than expected (and while they are still paying rent on it) to get it back on the rental market. You'll be able to redecorate it if bits are looking a bit tired, and you'll be able to let the LA take people round for viewings without the existing tenant needing to say what times are convenient for them. Since the tenant could stay until the final day without letting you know whether they were going to go onto a periodic tenancy or not, and refuse permission for viewings, I think you've got a really good deal here.

    Is this the school your boys go to? How are they feeling about it? I know youngest in particular doesn't deal well with disruption to the usual routine of things.
    Do you know anyone who's bereaved? Point them to https://www.AtaLoss.org which does for bereavement support what MSE does for financial services, providing links to support organisations relevant to the circumstances of the loss & the local area. (Link permitted by forum team)
    Tyre performance in the wet deteriorates rapidly below about 3mm tread - change yours when they get dangerous, not just when they are nearly illegal (1.6mm).
    Oh, and wear your seatbelt. My kids are only alive because they were wearing theirs when somebody else was driving in wet weather with worn tyres.
