It depends on the seat, on a Zafira where the rearmost seats fold into the floor and weren't accessible, it'll get an advisory from me, if it's the seats behind the front seats and the backs were folded down, the backs would have to be put upright to see if they secured in the upright position. If the car only had the front seats fitted, I would log on the test as a seating capacity of 1 seat excluding driver.
Sorry, maybe I should have been clearer, these are the seats I meant, the rear seats that fold into floor, not the middle row.0 -

There is no legal requirement for me to have indicators on my motorcycle, yet if I present it for an MOT with the indicators fitted then they have to work.
If I choose to remove them (either because it's by design or the law allows), then that part of the MOT test is skipped.Understeer is when you hit a wall with the front of your car
Oversteer is when you hit a wall with the back of your car
Horsepower is how fast your car hits the wall
Torque is how far your car sends the wall across the field once you've hit it0 -
It's not a legal requirement to have rear seats either.0

when mot'ing my seven seater, i asked the exact same question.
The response I got was "it depends" they said if the seatbelts were attached to the car body then the seats had to present to be able to test them, if the seatbelts were part of the seats then when seats were out there was nothing to test.0 -
