Insurance claim against my car.

    Just to give an update to how I am getting on, I am not. Put in a complaint in writing to Halifax, got a letter on the 14th March to say it has been passed on to my customer relations consultant who will get back to me when the investigation is complete. The on 24th March got a letter from Sabre the third party solicitors have provided details of the person who was driving my car, adding please confirm if this information is correct, should we not hear from you within 7 days we will proceed to settle the third party claim. AGGGH. Anyway on the next page goes on to say, the driver claimed the car was owned by his girlfriend, they wanted to settle outwith insurance but our client did,nt agree, she took note of the drivers girlfriends ph no and phoned to advise it would be sorted through insuance. the girlfriend statedthe vehicle was her fathers and she would lose the car that was,nt an option as she has 2 children and needed the car. She advised her father was in Spain and she wanted to have the car repaired before he returned. It appears that your insured may not know the driver as he was a friend of his daughter, I would be obliged if you could make your client aware of this information. This letter is from a Pauline Chung case handler for Lyons Davidson, Enterprise House Earl Grey St, Edinburgh. Does this make any sense to anyone as I am a female, you think they could just find out who the car is registered to. anyway got another letter from Halifax on 10th April stating unfortunately they are not yet in a position to respond to my complaint, and will get back to me by the 8th may. So there we go, getting nowhere.

    If it was not your car involved, did you write to them within the 7 days to dispute their claim.

    Yes, phoned them straight away emailed them and wrote to them, also told them to contact Halifax as they already have my complaint. I have been telling them from day 1 its not my car. Nobody seems to understand what I am telling them, I even have witnesses that seen my car at home all that day.

    Would a sworn affidavit help in this sort of situation ?.

    Swearing along the lines of 'my car was not involved in the aledged accident on x date, nor do I have any knowledge of the person named as the driver'.

    This was my thought.

    Looks like Halifax are getting it in the neck but Sabre are the ones who have really messed up

    There is information missing.

    Does the statement from the other party mention whether they recorded the vehicle registration or were they just given the policy number?

    If they were just given the policy number it could have been a made up number.

    Did they ask for / receive a description of the driver?

    What damage do they allege occured to your car?

    As I have said I have given all the information I have, not being funny but this is all I have been given, nobody has been to see me, nobody has phoned me. I am so annoyed about it. everyone is asking me for more details but I have none, ombisman cannot help me until i give Halifax 8 weeks so that is my next call. Spoke to police this morning and they told me to keep taking notes of who says what and who I talk to, which is not helpful at all.

    They cant tell me, that's why I am mad, now you see what I mean
