  • Need some more help on this please... I got an initial response on 10th march from cvs saying they would review my appeal and reply within 35 days. I have then received a rejection letter on 23rd April 2014. There is no popla code on the rejection though, what do I do next ?

    Complain to VCS about the lack of POPLA code. Tell them also that you are making the complaints to BPA and DVLA.

    Complain to BPA about the lack of POPLA code, and yet another case of their AOS member not following the code of practice they are bound by.

    Complain to DVLA that a BPA member has yet again breached their trade association's code of practice, hence breached their KADOE contract with DVLA.

    Check there is no POPLA form attached or printed on the back.

    Definitely no popla form, looks like letter headed paper. They say they wot reply to any more correspondences so do I still write to them complaining about lack of popla and hope they respond?

    do what post #23 said (report to bpa and dvla)

    let them decide what to do next when you write back again as detailed in post #23

    ie:- do all of what you were told !

    I got the letter on 26th Feb 2014 and the incident date was 12th January 2014.
    Was that Feb letter the 'Parking Charge' with photos? Could you have been too late to appeal as keeper because that was actually a follow up letter? Please check it.

    If so - if you reckon in fact you missed the first PCN - then I would write back and say 'Well as this was an Airport there is no keeper liability - I know for a fact there are prevailing byelaws there and they are NOT obsolete so don't try to pretend they are. If you write to state that I am liable as keeper you will be reported to Trading Standards, the DVLA and the BPA and the Airport owners. I also remind you that your PCNs are always held to be not a genuine pre-estimate of loss so without that and without keeper liability, to pursue this further would be pointless for you and harassment of me as keeper. Desist the contact or send me a POPLA code.

    {then you could add the bit about claiming your costs if they persist, it's on lots of threads about issuing a personal costs notification (PCN) of your own! }.

    I haven't seen a PCN with photos but my wife thinks it's possible she could have binned it so can't confirm. I'll do your suggestion coupon mad and write back to them with what you've put above
