CEL N1 claims form court stamped

Hi all,

This morning I have received a courted stamped N1 form - details of claim 'damages arising from breach of contract and Payment by the defendant to the claimant of the total amount £165

This arose from parking in the co-op 17/03/2012. I have ignored all previous letters/threats as advised on other threads. I would really appreciate any help/advice with this as I thought the company were just scammers - but I guess it just got serious

Many thanks in advance

If you wish to defend this, you need to acknowledge the claim, say you will defend in full and ask for 28 days to formulate your defence. Is this through MCOL or the bulk centre?
When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

MCOL = Money Claim On Line

bulk centre = northampton court does the bulk court claims for businesses etc to use when they are issuing a lot of claims like yours

try google when you dont know something, its a big help ;)

in your case, what people were asking is the address of the court from whence you got your court papers

You will know a bit more when you read the sticky thread for NEWBIES. I have a section in it about small claims and it tells you in links what happens when.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
CLICK at the top or bottom of any page where it says:

    There's no such thing.

MCOL (Money Claim OnLine) is done online through Northampton. Manual claim forms are submitted through the bulk centre at Salford, and can't be responded to online, you have to post all documents.

CEL do all their claims manually, so MCOL is irrelevant.

I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.

Can anyone advise on how I should best defend this/ stop it going further. Many Thanks
  • Hi all. I too have been sent a N1 claim form from Northampton. Ironically, this is from parking in a Co-Op car park in November 2012. It seems that as a lot of the Co-op stores are being taken over by Waitrose, they are trying to tidy things up.
I have ignored all previous correspondence so really they are stabbing in the dark as they have no confirmation as to my address.
I feel that by responding, I am showing my hand.
Also, I understand the PCN, if issued via an ANPR camera, must be issued within 14 days of the offence. I received mine after 16 days. Does this make this completely invalid..??
Also, it states that I had 28 days to either appeal/pay/give driver details but they sent a second demand after 21 days. Surely this is tantamount to harassment.
My question is, should I ignore or respond and have my day in court.
