Why?
If its bought in October then its under warranty surely? Where its delivered to is non consequential - the delivery cannot be made to the islands, but it doesn't state what the warranty terms are - they are the important element here - Can't see it being discriminatory of the islands - if they sell in the UK they should serve the UK for repair services.0 -
Thanks guys,a few of the things said,are hopefully helpfull.i won't be giving up on this,as iv done nothing wrong here.ill be phoning again and also try my local cab. I don't think where I live should make me responsible if it goes faulty.0

It's probably also worth looking up your SOGA rights as you're within 6 months so it would be deemed as inherently faulty until proved otherwise, which would mean that Homebase are responsible for transportation costs.
Surely under SoGA they'd only be responsible for the same level of transportation costs as were originally paid to deliver the item.
I know it's not explicitly stated in the act how this sort of situation would be handled, but a fair scenario would be to only expect the retailer to pay the same transport costs as in the original contract. Otherwise you could buy a bed from a small shop in Portsmouth, have it delivered by their one man and a van to your home in the town, then move to the Shetland Islands (or maybe even the Falkland Islands!) and expect them to collect it later.
In this case the consumer has moved the item a significant distance from where it was delivered, so it's their job to get it back to roughly the same place.0 -
I don't get why everyone is talking about moving it. Its an item, sold with a warranty. In the UK. Therefore the item should be repaired.
SoGA doesn't come in to it...yet. The warranty is there, does the warranty categorically state that they do not cover warranties in these locations.
I am not sure they are allowed to discriminate as the islands are still part of the UK - just because they don't deliver there (which will be a cost issue most likely) doesn't mean to say the product will never end up in these places.0 -

They are quite entitled to discriminate on whatever grounds they like in their warranty terms, as long as it isn't one of the 'protected characteristics' (eg age, sex, disability, etc). I don't believe it does come under this.
However, if the retailer and/or manufacturer refuse to honour the warranty, it falls back to the SoGA anyway.0 -

As I said before you deceived hem at time of purchase by masking the destination when it quite clearly says in their T&Cs that they do not deliver to the Islands.
They have already offered you an exchange or a refund. But you want them to come to you. Personally I don't think you have a hope in hell.
Are you a native or a settler? My money is on settler, because a native understands how things work on the islands and you clearly don't.0 -

Deception? There is no deceit here. The OP ordered from a location in the UK to the nearest location in the UK that ARGOS/HOMEBASE deliver to. The item was delivered to the address specified, in line with the limitations of service - all good, no problems there.
The OP now has a warranty claim with the retailer/manufacturer - that warranty is NOT limited to the place of delivery. The warranty is for a period of time in the UK.
Are the islands part of the UK? Yes. Is it the OP's fault that ARGOS/HOMEBASE don't have an engineer there? No.
They either need to find someone to fix it, or the OP needs to get it fixed and send the bill to ARGOS/HOMEBASE.
The delivery location has nothing to do with the fault that has occurred with the item.0 -

Cheers,I,m not a settler,born and bred here.i know of some companies that don't deliver here,so like what has been said you have to improvise.what I have learned is that the manufacturer of range oven, bush , is also owned by same group as Argos/ homebase,so don't think I would have had it if it was a different manufacturer.i still think warranty,s shouldn't have location issues.anyway been told to send letter to Argos,so will see what happens,will let you know outcome thanks for all your replies,I can see both sides of them,but will make sure things like this are checked out before buying again.0
