Autosec requesting address?

I received a parking ticket from AutoSec today and emailed them an appeal after reading through all the information on this site and the forums (thank you for all of that, btw! very comprehensive). This is the response I just received, two hours after my email:

I'm unsure of how to proceed, and don't want to shoot myself in the foot - surely they can get my address anyway? Is it worth withholding it? Any advice appreciated :)

  • I can't offer much help, but.....

    In your appeal you must provide the Reference Number, the drivers full name & address, and any additional information you wish to submit alleging that the contravention did not occur. Appeals submitted without all the requested information will not be addressed or responded to.

    Report them to the BPA for misleading appellants. A registered keeper can appeal.

    You have basically admitted to being the driver, so don't contact them again and wait for the notice to keeper to arrive. They want the address so it saves them £2.50 at the dvla.
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    It is a bit pathetic for free hosting, they are just an insignificant two bit operation that is probably just a one man band

    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    No he says 'registered keeper only' (he has followed my advice that suggests 'an early appeal from the keeper' where it's a small fry AOS member PPC like this!) so I think he should continue with the appeal by email exchange NOW and say:




    Thankyou for acknowledging my appeal. I am the registered keeper, you offer email appeals, that was my appeal and you have confirmed receipt.

    If you subsequently want a postal address then you can get that from the DVLA and then use it to send me my rejection letter and POPLA code in due course. There is nothing in POFA 2012 which says I have to furnish you with my postal address and indeed POPLA can be undertaken entirely online, at which point I would give POPLA my address as is the usual procedure I understand.

    In fact under POFA 2012 you can only get the registered keeper's address from the DVLA after day 28 - so you can't ask me for it now as you have no lawful reason to have it from me, nor this early. This is not an appeal from the driver - it is from the keeper and I have chosen to deal with it sooner rather than later. I don't mind awaiting your rejection letter once you or some random debt collector has purchased my data through the appropriate lawful channels - but be aware if you exceed 35 days in considering my appeal you will have breached your BPA CoP.

    For the avoidance of doubt, the driver will not be identified and I have lodged my appeal and have proof in the form of your response.






    (The reason I think he/she should press ahead now is that he can't have two bites at the cherry and won't be able to 'appeal again' at NTK stage).

    I disagree - I also think he has identified himself as the driver. The invoice must have been a windscreen one as the PPC would have the address if they had issued an NtK ( and the OP says he appealed on the same day as getting it) . Therefore the logic suggests that a person appealing a windscreen ticket is almost certainly the driver.

    Regardless, it looks an easy one to defeat.

    I have to agree with the above, the OP has in my opinion appealed too early, and has basically identified themselves as the driver. To their credit not admitted on the email, but this has given the parking company more ammunition. Not that they need to worry about a claim on this.
