Refunding of Football tickets

Options
Hi, just would like to know where I stand on this.

I recently purchased 2 x Football tickets for Brentford FC. Unfortunately due to the poor weather the match was postponed, it is only this particular match that I wanted to see and am unfortunately unable to attend of the rescheduled date.

I called the clubs ticket office to refund the tickets and they said that they will only do this if the tickets are returned. I no longer have the tickets as I discarded them once the game was cancelled.

The person I spoke to said that it was on the back side of the tickets, however I'm wondering how I can agree to something if it is only printed on the reverse of the tickets that we don't receive until after we purchase them?

Here are their terms and conditions from their website.

Terms & Conditions

All tickets, memberships and any other products purchased via this website are subject to the Tickets online terms and conditions. A full version of the Ticketing terms and conditions are available upon request from the Club.

Tickets online terms and conditions –

All tickets purchased are issued subject to the Tickets online terms and conditions, the ground regulations and the Ticketing terms and conditions.
All tickets are non refundable, and non transferable.
In the event of the date or time of the match being changed, tickets issued with the previous time or date will still be valid for the re-arranged fixture.
Should a match be postpones or abandoned for any reason before half time, the tickets will still be valid for the re-arranged fixture. If you do not wish to attend the re-arranged fixture, you will be entitled to a refund as long as the refund request is made in writing to the club no later than 24 hours before the advertised kick off of the game.
No tickets will be re-printed in the event of a tickets being lost or forgotten. If your ticket is stolen, you should report the theft to the police and obtain a crime reference number. On production of this reference number, the club will re-issue your ticket free of charge.
All tickets purchased are subject to a £1.60 booking fee.
Tickets purchased up to 3 working days before the game will be posted out to the registered address of the lead applicant. For instance, for a Saturday game, all tickets purchased before 15:00 on a Wednesday will be posted out. Any tickets purchased after this time will need to be collected from the Ticket Office on the day of the game.
If, for any reason, you do not receive the tickets through the post, please contact the club and we will arrange duplicate tickets for you to collect.
Brentford Football Club reserves the right to amend these terms and conditions at any time, and use of the tickets indicates your acceptance of such a change.

Not sure why you would throw the tickets away when you wanted a refund.

If they refund you without you returning the tickets there is nothing stopping those tickets still being used for free

although the online t and c does suggest only a written request is required

I discarded the physical tickets as I had no further use for them knowing that I still have the email confirmation and reference number linked to my order.

How does the club know you will not try to use the tickets for the postponed match?

I would have presumed that they would be able to electronically cancel the tickets although I have no idea how Football clubs manage their ticket systems and as a consumer that is not my concern or perhaps they should state it in their terms and conditions?? Which to me it doesn't seem to be.

They have nothing to refund as you no longer have the tickets...the email confirmation means nothing without the actual tickets.

When you ordered the tickets online, didn't you have to tick a box agreeing to the T&Cs?

Yes I did although nowhere does it state that in order to receive a refund I need to return the physical tickets.

I have purchased for a few events before that had either been cancelled or postponed or cancelled and none required me to return the physical tickets perhaps this is where my confusion is coming from - although there is still nothing that sates this in their T's and C's.

You purchased two tickets. In order to get a refund you need to return two tickets. Do you need something so obvious to be stated in the terms and conditions?

    Hi Tomontom,

This wasn't a question about whether I needed something as "simple" as this included in their t's and c's it was a question of if it does not state that I need to return the tickets then where do I stand legally, not logically.

Are you able to provide an answer that coincides with the law and not your own opinion?
