A refund is where the contract is cancelled.
Put it this way, when you buy a bed.....are you advised that if you want a refund, you'll have to return it?
Don't mean that to sound nasty, just the bluntest way I could think of showing the common principle that property/consideration given for a contract that does not go ahead should be returned to its owner.You keep using that word. This wasn't a question about whether I needed something as "simple" as this included in their t's and c's it was a question of if it does not state that I need to return the tickets then where do I stand legally, not logically.
Are you able to provide an answer that coincides with the law and not your own opinion?
That is the legal position. If you disagree you are free to go to small claims and have a district judge tell you the same thing.0 -
You purchased two tickets. In order to get a refund you need to return two tickets. Do you need something so obvious to be stated in the terms and conditions?
Tickets are merely proof of purchase. You are not paying for 2 physical bits of card/paper. You are paying for a service, ie entry to a game. The T&Cs state that cancellation in writing is all that is required. The contract is formed on those T&Cs, not what else could be sent afterwards.

But without a ticket you wouldnt get in and maybe the terms on the reverse of the ticket say something different it does say this on the online version

There used to be a useful page on Direct.gov about refunds for rescheduled events; no longer available.
However as to whether you need to return the physical tickets - unfortunately I can find no reference.
Given that the tickets remain valid for the rescheduled event it may be that you have to go through the 'lost' ticket process before you can return the tickets for refund.
However the written request for refund option makes no mention of returning the now no longer needed tickets.

I don't know what the legal position is, but I'd guess the club is right here.
They say that the tickets will still be valid the rearranged match, so there is nothing stopping you from getting a refund then using/selling those tickets. Although it does depend on the system - if it's electronic then you could argue that they could be cancelled.
Did you request a refund in writing within 24 hours of the advertised kick-off, or just phone them? I think you'd probably have a chance if you did email/write, but that's just my opinion.

I have just looked at the information printed on the back of Brentford tickets we used last weekend.
Under "Ground Regulations" it does say. "In the event of a postponement, the tickets will be valid for the re-arranged match. Refunds will be considered only if the ticket is returned complete to the ticket office not later than 24 hours before the time of kick off of the match, when played. It is the responsibility of the ticket holder to ascertain the date and time of the re-arranged postponed match".
I would have thought you are not going to have any luck with this one, sorry.
