Civil Enforcement ltd ignored all letters now have county court form help!

I parked in a shop car park in 2012 and overstayed as I went shopping and then had to breastfeed my baby. I sort advice and ignored all correspondence and now have a county claim court letter. I have tried to log in to MCOL but in my pack I don't have a defence password so do I defend via mail? If so do I fill out all my details on the form? And how do I go about putting together my claim? It is so long ago I thought it had all gone away

    When in 2012 is this, just pre or post October 2012 will do. You need to ring the court to make sure this is a real claim
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    Have you contacted CEL at all, at any time? If not then they cannot know that the registered keeper was also the driver - they are fishing. (Pre October 2012 means pre-POFA, where POFA brought into law registered keeper liability for parking charges [subject to certain conditions and criteria being met]).

    Ring the court to check that these are real court papers - sometimes fake papers are sent to scare people into paying.

    I am not sure how CEL lodge claims, whether through mcol or the manual way, so you do defence in writing. But I think you have one chance to submit a defence on the latter. But first make sure it's a real claim with the courts. It probably is to be honest. Some of the other guys have more experience in this, so please wait for further advice

    Is it it even a genuine claim form?

    If it is, it will be issued by the Manchester bulk service , not northampton, its off line, so MCOL isnt relevant

    I wonder if CEL have just done a new bunch of claims, i will send you a pm with my email address and will gladly help you defend this claim.

    CEL have a habbit of giving up against well defended claims

    CEL still don't invoke keeper liability now in their notices - just a fishing trip for driver's details.

    The Equality Act comes into play here - removing arbitary time limits for unlawful discrimination.

    Not really, given the number of claims CEL have issued, they fold against a good defence and go ahead when its not a good defence
