I have read the original post and understand it like this:

The OP has paid the full cost of the rental plus a security deposit of £150. This deposit would be returned upon completion of the stay provided no damage/loss were sustained.

The OP has cancelled the trip. According to the terms of the contract, as this has taken place more than 8 weeks before, the full amount of the rental has been returned to the OP minus the deposit.

It's all there in black and white. Why agree to the terms if you don't like them?

That is exactly how I and most others on here see it with 1 or 2 exceptions

I bet you any money that the OP will come back on and post that he has sought legal advice and has a case. He will later let us know that he won.

I dont think he will have a leg to stand on as the T&C are perfectly clear and fair.

Actually LittleTinker the case never required court action.
However you are correct in that I was advised that I did in fact have grounds to request a partial refund of the £150. As it happens I received a cheque this last weekend for the total rental and £80 of the £150 deposit on top.

It did require a written request for the additional £80 citing small claims action would follow. Whether I would have won or not in court now is irrelevant as I am satisfied with the outcome.

Thanks for everyones input (and I genuinly mean that), especially those who appreciated it from my side. :)

If that's actually true, I think that is a very poor show on your part OP. It's pretty disgusting actually that someone can sign a contract, agree to all the T&C's, then when it doesn't suit them, challenge them.

I can only hope the poor villa owners managed to replace you and they aren't left any further out of pocket. If someone did this to you, you'd be playing merry hell - some people are never satisfied.

Was the £80 refunded with a 'without prejudice' caveat?
