Booked villa in Florida and now can't get refund on deposit.

    Wow a lot of animosity from everyone on this board given that the facts are quite limited from your point of view. If we could have gone don't you think we would have?

    I suppose it's what I've come to expect from this place, nothing but shallow minded and aggressive behaviour to someone (quite new) looking for honest opinions and advice rather than a direct all out attack.

    Pathetic really.

    Put it this way - you're the one giving is the "limited" information whilst posting the entire contract you have with under the agreement.

    I just think you're a bit !!!!ed because everyone's pointing out your oversight and you're lashing out as a result.


    Pursue it if you wish - but I would be interested in the outcome of the situation whichever way it goes. It may be an interesting lessons for others out there that for one reason or other that could or have been in a similar situation.

    i completely agreed with your post sambee but can only guess OP took offense- clearly not for the first time!

    They seem to be annoyed at themselves for not taking out insurance but i am slightly concerned that anyone with legal training would waste time on this type of thing

    One small thing that nobody mentioned, but is useless in this here situ, is the 14 day cooling off period.
    Does that apply to deposits too and US law? I'm sure it does..... just a handy bit of info should the need arise. ;) oooo that's a point, which law would it go under, assuming that there are critical and vast differences between the two?

    Limited information regards our present situation as I wasn't attempted to curry favour in the sympathy region hence not all the details of why we cancelled has been posted.

    I'm not annoyed for not taking out travel insurance as I genuinly feel that keeping £150 for 6 weeks worth of time when there is still way over that before we were due to go is in my opinion unfair.
    As it happens the individual I was referring to before has also indicated last night that they too feel that the charge is unfairly high and they're just running it past a collegue before they advise whether a small claim court action could be taken.

    Now personally I would prefer not to go that far and just request a moderate refund of the deposit (50/50 I feel would be fair). I never came here for an argument but it seems everyone would be happy to side with the people who own the villa automatically just because they wrote something in terms and conditions. Have nobody never thought that not everything that is written in a contract is fair and legal? Not to mention that the contract is clearly designed by an american legal firm and as such taregetted towards an american audience and not necessarily binding in the English court.

    I apologise if my not accepting peoples wonderful advice to write off £150 of my money because you feel I ought to.
    Sam your post was removed because I reported it for abusive comments, if you had phrased it slightly more appropriately and diplomatically where you explained your opinion without resorting to abuse then it may have stood the test of time.

    14 Day Cooling Off Periods do not apply to travel.

    To paraphrase, the £150 lost deposit is entirely fair and justified.

    I'm not commenting on 'terms & conditions' being just / unjust a la bank charges, because we are talking about a cottage industry, quite literally. The OP made it sound like a couple renting our a holiday cottage, not a megalithic company boosting shareholders dividends, although I'd have a lot fun watching you try and take them on. I just hope that the couple can find someone to replace you at relatively short notice.

    Travel Insurance. There is nothing money-saving about not taking out insurance at the time of booking. It protects you should have to cancel as in this example. Only half the benefits of travel insurance apply when you are actually travelling. I've seen a lot of people lose a hell of a lot more than £150 because something bad has happened, and they hadn't got round to organising their insurance. DO IT AT THE SAME TIME YOU BOOK.

    And next time someone deletes my comments that are patently fair, right, and contain no personal abuse, do let me know.
