Booked villa in Florida and now can't get refund on deposit.

    Wow a lot of animosity from everyone on this board given that the facts are quite limited from your point of view. If we could have gone don't you think we would have?

    I suppose it's what I've come to expect from this place, nothing but shallow minded and aggressive behaviour to someone (quite new) looking for honest opinions and advice rather than a direct all out attack.

    Sam Bee is spot on, the 14 day cooling off period does not apply to this situation.
    As it happens the individual I was referring to before has also indicated last night that they too feel that the charge is unfairly high and they're just running it past a collegue before they advise whether a small claim court action could be taken.

    Yeah, yeah, we believe you. Thousands wouldn't.
    everyone would be happy to side with the people who own the villa automatically just because they wrote something in terms and conditions.

    Because the owners have done absolutely nothing wrong!
    Not to mention that the contract is clearly designed by an american legal firm and as such taregetted towards an american audience and not necessarily binding in the English court.

    Rubbish. The contract is a bog standard English contract.

    Now GET REAL, and accept that you have lost your money. Taking this any further will only incur you more costs.

    Cancellations
    Provided we receive written notice of cancellation not less than ten weeks before the holiday commencement date the hirers will not be required to pay the full balance, the amount of the deposit however, will be forfeit.


    Please detail and describe clearly and consisely exactly why this is an unfair contract term.

    Richard as soon as I get a comprehensive response I will tell you.
    Since I'm not a legal expert I cannot give the kind of answer you require, it does however go along the line of the charge being disproportionate given the length of time the booking was made and the costs involved in remarketing for the same week.

    Like I say I'm not a legal expert so I can't really give you any more than that. Sorry.

    So what should the charge be as a proportion of what?

    The remarketing costs may not be fixed, if they exceed £150, would you offer to pay the extra costs?

    Book a holiday - book travel insurance, simple really.

    Simple solution:

    take out holiday insurance, then try to claim on it for the lost deposit. Then you will be able to complain to the Ombudsman, and post any number of messages here about unfair insurance companies who fail to compensate you for things that happen before taking out insurance. Think of the fun you can have!
