landlord not renewing tenancy - Help

The courts have replied and very kindly given me more than 42 days grace. I asked very politely if they could extend it by a few extra days so the children could finish school and they agreed.
The council have made a first and final offer of accomodation which is unfortunately miles away from work and both schools. Whilst I am grateful to be housed, The council have informed me that my petrol costs will probably exceed my part time earnings and that I may have to give up my job .... Well that doesn't sit very well with me. I want to work and set a good example for the children so I have started an appeal backed by supporting letters from the childrens schools (my eldest has done his first year of gcse's so I will not be changing schools as he is exceeding all expections and it is a fantastic school)
My local MP is behind me as well and she is very good at this sort of thing apparently.

Sorry to bring this thread back up again but I am having trouble getting my deposit back. I moved out on 21st July and the checkout inventory was done on 22nd July.
These are the emails that are going between the management company and myself

As previously discussed with you, the house was not cleaned prior to my moving in and was absolutely filthy and is noted on the check in inventory. The garden only needed a mow which had not been possible due to the severe downpours and thunderstorms. When I moved in the garden was about 3ft high of brambles and nettles (which I removed) and was shown as not being inspected on the check in. I note red lino being shown on the inspection report in the inventory as being different, Its always been there and has never been changed. Damaged to the ceilings is an issue between you and the landlord as the landlord wouldn't repair them as he thought the sub contractors of your company should be responsible. I will dispute any charges with DPS especially as I have it in writing from the landlord that he would not allow you to deduct anything from my deposit

Go to the deposit scheme now and reclaim the whole deposit.
if they want to claim anything they have to make their case to the scheme.If you've have not made a mistake, you've made nothing0 -

You have lived in the property for 5 years and paid the Landlords Mortgage during that time.
To try and make any deductions after 5 years is taking the PXXS
You have already contacted the DPS people and the Landlord has to prove any damage or alterations ( Not agreed)
With a crap Check In Inventory he can prove nothing
Wait and see what the DPS people say ( Give them a call every few days)
If you do not get ALL your deposit back then look on the shelter website at how to write a " Letter before Action" telling the landlord you will sue him/her in the small claims court and you will win ( they will have to pay costs)

I had a conversation with the DPS today and they suggested a single claim, I then spoke to the letting agents (who think my landlord is being ridiculous)
Anyway he is claiming :
£180 for a gardening quote (not inspected or seen on the check in inventory and was waist high with brambles and nettles when I moved in)
£170 for a plumber to plumb in the washing machine (It wasn't plumbed in when I moved in and it has been stored in the garage for the last 5 years as I had my own washer dryer)
£475 to clean the carpets upstairs as there is evidence of a pet ?? I had 2 budgies in a cage in the kitchen ... never had a pet upstairs and my budgies were named ... yes named you did read that right on the tenancy agreement)
£280 court fees ... yes I'm fine with that ... absolutely no problem in me paying that
and an electric bill of £170 .. strange one that as I have had a refund for my gas and electric of around £170 as I was in credit
Funnily enough that totals £1275 ..... my total deposit :mad:

The DPS people will ask to see the check in Inventory and look at how long you have lived in house.
He will lose but you must follow up with Letter before Action and then take him to court.0 -
Just a little update.
Finally I have a result from the DPS after a lot of trouble with the letting agent.
I have had my whole deposit returned minus £20 for cutting the grass (They were claiming £180 for gardening) and the £280 court fees. I had so much photographic evidence and emails from the landlord disproving alot of what he was trying to claim.There is a forgotten, nay almost forbidden word which means more to me than any other. Worth noting for others in a similar situation that even if the council insists you remain in the property, the tenant still gets clobbered for the court fees.
Where are you living now? Your last posts suggested it was a council place in the wrong town.
