With all due respect to Daisy, solicitors will ALWAYS play it as safe as they possibly can - they fear being held responsible for bad advice. The problem is that too many people take solicitors words as gospel. I've often dismissed solicitors advice and I'm still here to tell the tale ( and not banged up ! ).

Absolutely, I couldn't agree more. The problem with asking (most) practising solicitors for advice about parking cases is that they are highly unlikely to have any expertise. How many specialist parking claims solicitors do you know? None. Why? Because they are in business to make money and there is no money in it for them. Same goes for advice on benefits, small tribunal claims by employees, and so on. They don't have the time or the interest to get up to speed with such areas, and have no inclination to get involved in campaigns for justice. So they play safe and give bog standard advice.

EDIT: ps - I am pretty sure that OP does not have a rejection letter or a POPLA code yet. She is just getting ahead of the game in posting her draft appeal to POPLA, on the basis that a ANPR are expected to reject her appeal.

Nope - it's nice to see someone being prepared. Keep going as you are.

You have plenty of time to construct a POPLA appeal -
so please do RELAX and CALM down - get this into perspective.

Trev (director of ANPR) is a real comedian and easy to beat at POPLA.

Should KIFL's letter not prove fruitful in providing a POPLA code - then you will need to make formal complaint to the BPA and DVLA.

Of course there is another option still open to you to get this quashed now and that is to make a formal complaint to the retailer/landowner (haven't read whole thread again) - they obviously can instruct ANPR to cancel this.

Regarding being prepared - yes it is good to be so - but I'm thinking of Siross's thread - he posted up a draft POPLA appeal before getting a POPLA code and it took an age and numerous complaints to get a code - this did however make the BPA to issue the statement that POPLA codes should be given out after an appeal (not that it has been effective yet)

OP. In your draft POPLA appeal you need to get rid of appeal point #7 as despite the name of this outfit they haven't used ANPR - they've simply stuck a ticket on your windscreen.

I'm not sure whether they have any ANPR capacity at all - anyone confirm?
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

    Thanks
