Presumably I would want to insert your paragraph where points 1) 2) or 3) are.
The issue I have is that none of those existing points are relevant to my case as presumably I just need to tell them that they have not complied with POFA12 and that this alone is grounds for them to cancel the case against me as registered keeper.0 -

Nope, you presume wrong. Points 1, 2 and 3 are always relevant, hence why I have written it as a template 'one size fits all cases' appeal. Just add a point #4 because the late NTK isn't a magic bullet on its own to get the thing cancelled.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thanks for clarifying. I have drafted my letter from the template, including the above mentioned paragraph.
I have one final problem. The initial windscreen NTD was from UCS parking ltd, but the NTK, and now subsequently a chaser sent the day before I even received the NTK are from TNC parking services. Who should my appeal letter go to?0 -
TNC - who are shocking - a debt collection firm who don't know the meaning of the words 'compliant Notice to Keeper'. If you have an address for the PPC then send them a copy too and ask which one - them, or their pet debt collector - are going to issue your POPLA code, and if they do not you will complain to the BPA Ltd.PRIVATE 'PCN'? I have added this point into the appeal template:
4) As the Notice to Keeper was received outside the limits prescribed by PoFA 2012, the keeper no longer has any liability.
I have also drafted the following to send to UCS:

Please find enclosed my appeal against a non compliant Notice to Keeper which I, as registered keeper, have received from a TNC parking services.

Ok, so 3 months after sending the letter described above, I have now received an orange letter from TNC which claims to be an intention to take matters further i.e. threatening legal action.
What is the protocol when these cowboys do not send you a POPLA code and continue with their bullying tactics to try to get money out of people?
Is the next step a complaint to BPA or do I have to continue correspondence with TNC?0 -
Reading through this a few other posters have asked the question
The lease/rental agreement will trump any made up rules from a private parking company, and depending on what it says you could pretty much tell them to shove their permit where the sun doesn't shine and just park in your space without the permit.If you are a tenant do you have an AST? (Assured Short-Term Tenancy)
Check what that says regarding parking.
What does your tenancy agreement say regarding a permit?
You could then just play the POPLA game, tell the management company that in line with your rental/lease agreement you do not need a permit to give yourself or anyone else permission to park in your space.
Next just collect your daily parking charge, challenge it and do a a popla challenge for each and every one.
But before all that the important question that ( as far as i can see) hasnt been answered is what does your rental agreement etc say with regards to parking??From the Plain Language Commission:
