    Bod1467- To be honest Im not sure about an AST i'll have to check my paperwork, but I would imagine so, the let was arranged by an ARLA approved estate agency.

    HO87- Thanks for this, however I am not too sure how I should proceed with this information. Once again I will have to check my agreement about whether a permit is mentioned but how would my next step differ depending on whether it is or not?

    4consumerrights- This would seem like the most simple course of action and from what I have read so far, seems like the way forward unless a way of putting an end to this sooner comes to light.

    Spacey2012- I was aware of the need for a permit. I was initially assured, by my estate agent (over the phone), that the management co had been made aware that I was without said permit and that one had been ordered and that in the meantime "they would call off the dogs". I didnt think much more about it assuming that perhaps the permits were issued annually or something as I didn't get a permit or a ticket.

    The next time the thought crossed my mind was when the ticket was put on my windscreen.

    On investigation the management company claimed to have no knowledge of my permit being ordered (odd since I hadn't had a ticket in the last 6 months). And my contact at the estate agency had recently moved on. When I suggested to the lettings manager (by email) that perhaps my contact had not performed his job as I was under the impression he had, I received an email reply from the agency owner, telling me he had file notes stating that my contact had informed me that I needed to purchase a £5 permit from the management company, and suggested that I simply had not done so. He was however kind enough to offer to reimburse me the £5, needless to say I have not accepted this "goodwill gesture"

    I have of course now purchased the £5 permit regardless of the fact this is essentially extortion as its a small price to pay for avoiding the hassle.

    I am not sure whether any of this is relevant but if it is id rather not omit it!

    What does your tenancy agreement say regarding a permit?

    You paid £5 for a permit - sorry you must be mad (no offence intended) as many of these parking companies only charge around £1.20 to their client and it is the clients who order and pay for them. (Considering the set up in this case - there is no loss to the company at all and they are fleecing residents) You should also be aware that many parking companies offer their services free and give a cash back-hander to their clients on the revenue gained from collecting parking charges.

    With regards to your dealings with the Estage Agent - you should check if they sign up the the TPO and you could file a formal complaint:

    It you were not given a permit at the start then you cannot possibly comply to any contract so it is a frustrated contract and void on the grounds of unconscionability.

    DO WAIT UNTIL THE NOTICE TO KEEPER THOUGH - as TNC are the backroom operators for UCS with their parking services -there is no keeper liability on their letters so the only pursuance of the charge is if the driver is known.

    Please also edit the photographs of the parking charge notice as you have left in the location.

    @OP as a tenant you are most likely to have a rental agreement aka lease. Whichever, but is your access to a parking space set out in the document and does it include a requirement that you display a permit?

    So, as expected I have finally received a NTK it is dated 9th May but I only received it on 16th. The PCN left on my windscreen was dated 5 Feb.

    For this reason and NUMEROUS others the NTK does not comply with POFA 2012 as @HO87 suggested would be the case.

    I have read the MSE PCN forums and found the template for an appeal letter but this seems pretty long winded. I am aware that certain things need to be included in the letter regardless of the reason for appealing to aid in any subsequent legal issues, but does anyone know of anywhere I can find a template specifically relating to a non compliant NTK?

    Which part of the appeal template do you feel doesn't apply in your case?
