UCS Parking Ltd(Photos available for reference)

I am a resident in a managed property and the parking enforcement is operated by UCS parking Ltd.

As a result of some confusion between myself and the estate agents managing my let i was not issued with a parking permit (it turned out i was supposed t go directly to the management company- more on them to follow), having had no problems for 6 months I hadn't though much about the permit until i received a parking ticket from UCS.

From what I have read in various threads on various forums, i gather that I shouldnt be paying this.

I would like to know what course of action I should be taking. I have added photos of the ticket and the notices that are up around my block for reference. I have photos but as a new poster cannot post.

I would also like to add some research I have done on this company.
UCS parking ltd, although listed as a non trading company has submitted trading accounts to companies house. I have also discovered that UCS is wholly owned by "Co X Ltd" which, as it turns out, also wholly owns the company which manages the property I live in, a company called "Co Y Ltd". The ultimate beneficiaries of this operation are the 2 shareholders of "Co X Ltd", Mr and Mrs S. (This information was correct at the time each company submitted its last annual return and may have changed since...)

    the photos can go to sites like photobucket or similar and you can add a non-live link by removing the http:// from the url

    UCS are BPA AOS members so CoP applies and, presumably, we should see POFA compliant paperwork.

    @OP - is the space included in your lease? Is there any mention of the necessity for a permit in it?
    My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

    HO87- I am new to this can you let me know what CoP means? Also, i am not the leaseholder, I am tenant. Does this change things?

    CoP is Code of Practice ( the BPA "rules" )

    I assume you know what BPA means ?

    Thanks, I am aware of BPA AOS etc.

    Having read the original thread that you have linked and I am slighlty confused as to whether UCS are a small firm who I should appeal to straight away to or whether I should be waiting for a NTK? I should add that the original "PCN" was left on my windscreen.

    If you are a tenant do you have an AST? (Assured Short-Term Tenancy)
    Check what that says regarding parking.

    The PCN's are not compliant - where to start, well the creditor is not identified for starters.
    I can see no valid offer to contract in the signs.

    @OP as a tenant you are most likely to have a rental agreement aka lease. Whichever, but is your access to a parking space set out in the document and does it include a requirement that you display a permit?

  • If this is like another recent case with UCS wait until you get the notice to keeper which will be from TNC parking services. DO NOT REPLY AS DRIVER and there is no keeper liability. Having seen a TNC notice with UCS -they even upped the parking charge. - which is being dealt with off forum

    If this is one of the same as the management company, they had a legal obligation to mitigate any loss by informing you from the outset that you needed a permit and should have supplied such permit at the start of the tenancy.

    A district judge would kick them so far out of court they might go in orbit .

    The signs quite simply state that permit holders only may use the car park. The corollary of that is that everyone else is thereby excluded. Having excluded everyone you cannot then make an offer (not that there is one) suggesting that they must pay £100 for the privilege. The signs are thus a nonsense and the charge is actually a disguised penalty.
