UKPC do not take people to court, and even if they did they would lose as there are two different contractual charges posted, how is a chap to know which one is right.
You have absolutely no need to worry about this, if you felt like it you could completely ignore the whole fiasco, or you can cost them some money for their cheek.
They will have to pay some £2.50 for your RK details, and a further £32+ if you appeal.
Their whole business is based on scaring people into paying, you are made of sterner stuff.You never know how far you can go until you go too far.0 -
There are some excellent first appeals on here and Redx has a good generic one that will come along, or you may have found it already.
I am suggesting a new paragraph to be added at the end to deal with current trends but other regulars may take a different view. The aim of this is to get the ticket cancelled without involving POPLA
"Note:- As you will observe from my appeal, I am being aided by experienced forum members with this appeal. You will also know that POPLA are not persuaded by submissions from PPCs who do not present required contract information or whose Genuine pre-estimate of loss (GPEOL) is unsubstantiated. You may also be aware that recent court cases have also found in favour of motorists who can present a good case, some of whom have been supported by the same forum contributors who are advising me and have offered their continued help.
In view of this, I would ask you to carefully consider whether the time spent in preparing a POPLA case along with the POPLA fee is a good business decision and whether or not it may be a pragmatic move to cancel this appeal and instead concentrate your efforts on others who may be less resolute."0 -
I would suggest that instead of "unsubstantiated" you say "costs not arising from the event" or "day to day running costs". as I suspect that PPCs genuinely believe that ALL their costs are substantiated.You never know how far you can go until you go too far.0

How can the car driver be sure if that area belongs to single owner or not? There was no sign near the entrance nor in front of that unit door. The nearest lamp post was located good 8-10 mtrs away and in front of unit that had notice on the door as well.
I thought the fact that there were no signs front of that unit will add weight to my appeal.
None of that (about signage) will be the point that wins and I would forget the landowner - the Uni of Cambs won't be interested in this.
Please use the generic first appeal in the 'NEWBIES read this first' sticky thread which already has strong enough wording in its own right. I recently removed all the different templates last week and wrote just one for all situations - which suits yours fine.
This is easy and nothing to spend ages over, you just need to send the generic first appeal, to get a POPLA code. Then you go back toi the NEWBIES thread and read 'How to win at POPLA' in post #3 of the sticky.

Better to get them to back down at the earliest opportunity.0 -

I think the trouble is that the people reading the letters are not competent. They are just given a routine to follow so it will take some time for it to dawn on the parking companies that there is code in the letters that says don't bother fighting this one. It wouldn't surprise me if the process was simply to check the letter was an appeal, not some other communication, check the parking ticket reference and then generate the standard response. It would be interesting to know how many people had letters that demonstrated that the person at the other end had read first appeal letters and responded to the entire contents and how many got a collection of standard paragraphs.0 -
