Had a problem with this company. They took two transactions of 39.99 from my bank. I looked in their terms and conditions and as per their refund policy, sent off a request in writing within the correct time frame to have this money refunded. I sent this recorded post and have proof of delivery. Within a couple of days one of the 39.99 transactions had been refunded. Since then, around 6 weeks has passed with no sign of being refunded the other 39.99. I rang them in January and they told me it was due to be refunded on 4th February. This time came and passed. No refund. I rang again on the 6th, they were apologetic and said I would have it in 1-5 days. 11th of February came, no refund. I rang again and was again apologised to. This time I was told that he was processing the refund there and then and that it would be definitely in my account my 'tomorrow'. It wasn't. So I rang back the next day and was apologised to and told 1-3 days. I'm not holding my breath. Where do I stand with taking this company to court, given that I requested the refund with proof of delivery well within the 14 days stated in their T&Cs? I've already got complaint forms for the FOS ready to submit after 8 weeks has passed. Has anybody else dealt with this company? Absolute low life scam artists is a generous description. Would a small claims court deal with this for me?

    Why do you keep ringing them?

    You already know what to do, you are simply spending more money on phonecalls. You're not seriously hoping they will buckle under the amount of phonecalls??

    Wait until 8 weeks is up and fill teh forms in for the FOS and stop looking for loans from loan brokers like loanzoo. If you want a loan try reputable lenders like the banks or the financial side of the supermarkets.

    It's costs nothing, and surely phoning them and trying to exhaust all other avenues before taking things further is the correct thing to do?

    Cancellations and Refunds

    Cancellation of Membership

    We charge a fee up to £44.99 for providing the service of acting as a finance broker. By proceeding with your application you are agreeing to pay our processing fee. We specify the fee as part of our communications with You. If You do not enter into a loan offered by a lender or financier within the 3 months We act for You, We will refund your full administration fee minus £5 as stated in the Consumer Credit Act 1974. Refunds must be requested in writing at customerservices@loanzoo.co.uk to avoid repayments being sent to a wrong address. In the event that your card is declined, we will attempt take payment on that same card as many times as we desire for up to and including 60 days after you made your application. If you wish us to stop trying your card please inform us by post or email.

    Cancellation
    Under the Financial Services (Distance Marketing) Regulations 2004 you have a right to cancel your application within 14 days of receiving these terms and conditions and receive a refund. If You wish to cancel your application, You must write to us. In this event We will refund your fee within 30 days of the date on which We receive your written request to cancel your application.   • Phoning them is NOT the thing to do.

    Do as DCFC79 above suggests. This will cost the company several hundred pounds in fees from the regulator (about £400 I think) and is far more likely to get your money back than any amount of phone calls will achieve.

    Hi, thanks for your reply. I'd never even heard of this company before they helped themselves to this money let alone applied for anything from them. I applied for a payday loan over Christmas that apparently had some shady terms and conditions attached with regards to supplying details to third parties. Naive of me admittedly but I wasn't even aware that it would be legal for a company to pass details to another company and for them to take money in this fashion. The FOS said they have been inundated with calls about this kind of thing recently.

    Anyway, is this something that small claims courts would be able to process or will the FOS be able to resolve this?
