Benefits Help after Resigning

Hi long time reader and lurker unfortunately this is my first time posting on here as I need some help and advice :(

a bit of back ground , I currently work for my employer and have done for 12 years , unfortunately I done something that has made my position unattainable I am currently suspended pending disciplinary (I have basically admitted to what happened and I would be sacked with gross misconduct if I go down the full disciplinary route.)

My employers have advised me if I resign before the meeting , then all disciplinary action will cease and I will be allowed to leave with immediate effect and will still be able to get a reference etc

My question is this , if i resign will i be entitled to any benefits ? i have only been unemployed for 2 weeks of my adult life (i am now 31) so paid all my tax / NI as I should for that time.

If anyone needs any more info to offer any assistance please say and thanks for any help I may get

If you resign you will get no jobseekers benefit.

    It's 'untenable'.
It would appear to be of benefit to them if you resign, so what else are they offering apart from a reference?

This implies you might do if sacked for gross misconduct, which I don't think is so.

makes little difference if your sacked or you resign in terms of JSA, the reason will still be investigated and a sanction can be imposed.

Not strictly true to cross hairs - it will be suspended for up to 3 months (I think it is 3)

This sanction would be reset - as I understand it - by working for any other employer for any amount of time.

Either way you'll have trouble with benefits so your only option is to resign and take the reference. If you wait to be dismissed you'll still be jobless with no benefits but also unable to get another job.
    This is a no brainer.

Its six months max and it is suspended whilst it's investigated and then potentially disallowed, if it was disallowed its likely to be for the whole six months unless the job was expected to end earlier which it clearly wasn't.

If you are likely to be sacked through misconduct then I personally would resign and get my reference.

I agree its a no brainer , whats the likely timescale for me to be sanctioned ?

I don't expect to be out of work for a long time (fingers crossed anyway) but in the mean time i will have no means of income whatsoever , so how would I be expected to attend the job centre / interviews / apply for new jobs etc ? never mind putting a roof over my head.

I am currently still suspended , but will be handing in my resignation next week when i get my invite to the discplinary procedure.

    Thanks for the replies
