Help with Ebay/paypal please

Hi all
I sold an iphone in december and the buyer paid via paypal.

I then received an email from her ebay account asking if she could collect- i live alone and didnt really want a stranger at mine so i said no.
She then asked if i could send it to her work address instead which i agreed to do.
Today i found out she had opened a file with her credit card company saying it was an unauthorised payment and she has been refunded as i am not covered with paypal due to sending to her work (i stupidly didnt know this)
I am now an iphone 5 and £326 out of pocket yet she has both the money and phone.
Surely she has defrauded the credit card company???

What can i do???

    Ok, you are going to have to take the legal route. Firstly contact the buyer and play a little naive and ask whether they were aware that someone was now claiming fraudulent use and although you have been advised to persue this through small claims you thought you would check with them first in case there was a mistake.

    If that doesn't worry them then you may well have to go,to small claims, but buyer could of course turn round and say he never asked for it to be redirected to a work address.

    If you feel aggrieved enough you could always phone the employers , where the item was delivered , and ask if xx works there as you need to be sure so that legal papers can be served. Yu do need to be careful though to stay legal when talking to a third party.

    I've done the phoning employer thing myself, my dodgy buyer was a partner in a New York law firm and they asked me specifically what had happened as they preferred to deal with it in house before I opted to deal with it legally.

  • As above, unfortunately you won't get help from eBay/Paypal but you do have a legal route, albeit it's not cut and dry and it doesn't mean you will get your money back. TBH that is very unlikely.

    Document everything ,keep screenshots and be factual.

    Do you have your proof is posting?

    I had a seller deliver an item at night and wrapped up. By the time i had unwrapped it - he had gone. It was not only used, but faulty.

    I asked for a refund - but he basically told me where to go as i paid cash. But fortunately - i had noticed he delivered it in a works van. So i told him i would contact them for the refund - as clearly they delivered it, so they had sold it to me. Refund was posted through my letter box the next day.

    So defo try the work route.

    You don't know at this point of its an hacked account or just a scam buyer. But contact action fraud etc and then try and find who it was you posted to and if its a genuine work address.

    Print off the item page and buyers details etc - as they won't be there for ever. And make sure you keep the messages asking you to post to an alternate address.

    Print off a Royal Mail screenshot stating item delivered.

    If it is confirmed the buyer works there surely that will help with your case...how would you know were they worked unless they had told you?

    You would think if it wasnt her she would have contacted me and said someone had been using her account etc and she had contacted her credit card company for a refund????

    As above, gather as much info as you can, taking screen shots of everything was a good suggestion as time may well mean some things start to disappear.

    Firstly is the delivery address on Paypal very different to the actual address you sent to?

    Hope you mean proof of delivery. You did send tracked?

    Tech, it's a chargeback, proof of posting is enough, in normal circumstances, but this POP will (I'm guessing) be to the wrong address, as in, not the Paypal transaction address......which is why I asked HOW different.
