    Could you provide a link to what you say please? Just to clear things up. Preferably not a link to foreign country but something linking it to UK law, it would be most helpful.

    Ideally a stated case.

    I don't have a link but live with a lawyer and a solicitor and sadly this is right.

    Personally I disagree with it. In cases like wind even if they had 50 trolly collectors all it takes is one carless customer to dump a trolly anywhere, then a gust of wind and the accident would have happend. To make this 100% fool proof you'd need staff to escort each customer to their car that remove their trolly to a safe location. This of course would not be possible.

    I'm not sure though without checking again if the retailer would have a good case for it being accident due to the nature of the incident. With wind even if their staffing level was adequate for the level of trade the staff can't be everywhere at once.

    I would take their offer.

    TBH I wouldn't have even thought to mention it to Sainsburys, I would have thought it my bad luck.

    I used to work for a supermarket (many years ago) and despite signage they paid out loads of times for damage done in the car park. It was not an admission of guilt or negligence (because it was not their fault, it was another customers fault) but done as a goodwill gesture.

    Someone earlier suggest lies and fraud to get what you want. In the store I worked for if an estimate looked inflated then they would demand that it be taken to a particular garage for an estimate. If it was found that the estimate was inflated (or the customer tried any slick talk with the garage owner) then they got nothing and were told to take it to court .. of course a big issue was made over the integrity of the person.

    You owuld also be surprised at how many people damaged their own cars (either accidentally or deliberately) and then tried to make a claim.

    No, but a Sainsbury's employee did fail to ensure THEIR trolleys weren't blowing around in the wind hitting cars.

    the point here is they didn't take any reasonable steps to stop it from happening, in that they didn't even have anyone collecting trolleys that day (unless i've misread the OP)

    Irrespective, I would say the fault lies with the customer who did return the trolley to the appropriate area ...Sainsury's were also an innocent party .. the car could have damaged their trolley .. maybe they should make a claim against the car owner :)
