    It includes a full explanation of the acronyms and how to appeal (in detail) which is why you need to 'read it first' please. It helps us not to have to repeat what you can easily read first, there.

    Hi,

    Thank you I have read through the sticky threads, but I feel I should mention I already try to save myself some money by not paying for my ticket until 10.00am when it is only £3, they clocked me at 9.30 when I should have paid £7.00... Does this mean I dont have an argument to write back to the NTK as I hadnt paid at the time of parking?

    the fact there then is you owe them the price of the ticket for parking plus collection costs (the genuine pre estimate of loss)

    so not the inflated charges they are claiming

    lets assume they sent you a charge of £12 like the OFT indicated, that would be fair due to parking ticket evasion
  • It does not matter much what you've done. or not done. The whole approach is the same and you'll be fighting them on contract terms.

    So assuming that the signage referes to 'breach of conditions' or 'failure to comply' then get a soft appeal (wording courtesy of others) in for each ticket...

    As the registered keeper of (reg) I'm in receipt of your parking invoice xxxxxx dated xxxxxx. I wish to invoke your appeals process as all liability to your company is denied on the following:


    1) The amount being claimed is not a genuine pre-estimate of loss to your company or the landowner


    2) Your signage does not comply with the BPA Code of Practice


    3) You are not the landowner and do not have the capacity to offer contracts or to bring a claim for trespass


    These points and others will be raised with POPLA should you not accept this appeal, and you will be expected to provide a full breakdown of your alleged loss, and your full unredacted contract with the landowner.


    If you do reject the challenge and insist on taking the matter further I must inform you that I may claim my expenses from you. The expenses I may claim are not exhaustive but may include the cost of stamps, envelopes, travel expenses, legal fees, etc. By continuing to pursue me you agree to pay these costs when I prevail.


    Any communication that does not either confirm cancellation or include a POPLA verification code shall be reported to the BPA as a breach of their Code of Practice - the BPA recently issued guidance to all members to remind them of this fact. Such communication may also be deemed harassment and pursued accordingly.

    Thank you, that's great I will send them two of the above letters to them now and then as you say prepare for the POPLA code letters I will probably receive...
    I know the first letter I did already write to say I believed I had paid for this and used a photo First Capital Connect payment of £50.00 taken out of my account, but I now believe this was for another ticket I had already paid.... Shall I still send this letter even though I havnt heard back from them regarding my reply?? (I know, I was stupid to reply to the first one now I've read this!)
