Advice desperately needed

    Get your deposit back, start looking for another car. Don't waste your time going to court. Call it a bad experience and move on!

    Beware, some dealers use unavailable cars to lure in punters, then when the deal is done they reveal they can't have the car and then offer them the old shed in the corner instead.

    Well, since I posted this I put a request for advice on a local to me Facebook Motoring site. I did not name the chain of dealers, BUT, someone else did and said they were treated the same way. Bought a car from them, paid the deposit, and were then told the car was sold. I have since found another four people have been treated this way by the same group of dealers.

    The dealer network that have done this to me is Stoneacre and I have taken it up with Trading Standards who have said they are in breach of contract.

    I have been told to send a letter of complaint by recorded delivery and give them a deadline to reply to it, which is what I have done, I have also emailed the area manager with a copy of the letter and I await their reply by which time Trading Standards are wanting me to inform them exactly what they offer to do.

    I'm confused have you had your deposit back or requested it back?

    Yes, they paid my deposit back this morning without telling me.

    This is not the issue, the issue is they sold me a vehicle then told me the vehicle was sold but they could sell me another one for about £6000 more, all while the adverts were still on Autotrader and ebay website over a day later.

    What if when you did see the vehicle it was a bag of nails? (not as described) Would you have still felt obliged to make the purchase? Whilst the early bird gets the pick of the worms, the 2nd mouse gets the cheese.
    Personally I think you are wasting energy taking it further, for me deposit or not, the 1st with the means to buy gets it.
    You don't have to ultimately purchase from them, and I'm sure I have seen some on autotrader for a couple of grand more than you were hoping with delivery mileage on the clock and perhaps room for negotiation?

    Yes I see exactly what you are saying but this was a brand new vehicle, pre registered with the full manufacturers warranty so how on earth could it be a bag of nails. Further to this I had the means to buy it and I also had a conversation with the sales manager to see if there was a mark on it to which he said it is a brand new car. They requested a £500 deposit immediately to say the vehicle was mine. I then had to visit the showroom at a date to be confirmed by them to collect and make the remaining payment.

    The reason I went for this one and basically did everything they asked of me was purely because it was £2000 cheaper than anyone else!!!!

    Sounds like you may have never had a brand new car before? New cars can be bothersome sometimes too.
    Anyways considering it is now a new month, perhaps he dealership wanted a deal closed by the end of the month and hence why the special deal was on the table? I don't know, what about meeting halfway on £21k on a delivery mileage example? For me though brand new cars have to be a bespoke example.
