Satellite Dish overhanging onto my property!

    Not sure of the legalities, but it is certainly contrary to accepted good practice to site a dish over-hanging another property without permission.
    If a tree or bush over-hangs your border, your can prune it back so I'm fairly certain an affected property has some rights in that respect.
    Very few properties would only be able to accommodate one location for the dish, once the installer had decided where he had line of sight, the position was likely chosen for ease and length of cable run than anything aesthetic.
    Change is inevitable, except from a vending machine.

    I'm not saying satellite dishes are attractive, they're not but many of us have them on our houses. Hopefully after a while, you will get used to your neighbour's new dish and the look of it won't annoy so much.

    NB if they did go onto your path to set it up, then it would have been polite to ask but I would not fall out with my neighbour about it now.

    A property owner owns the air above the property they own.

    Kelsen v Imperial Tobacco is a similar case to the OP where an advertising hoarding was deemed to trespass a neighbours airspace. The owner of the sign was ordered to take it down.

    These things should always be considered in the light of what happens if i want to sell my property? A potential neighbour dispute could put off buyers.

    I would want it removing, but I would like to think I know my neghbours well enough to have an adult discussion about it.

  • Many thanks for all the quick replies, with my line of work I deal with neighbor disputes everyday in regard to trespass onto property and of it's airspace, and I'm certainly not a pain in the butt neighbor!

    When I bought the house 2 years ago there was a redundant sky dish in the same place which I informed the tenants at the time of the legalities and they duly removed. Unfortunately the lazy Sky installer has returned whilst I was out all day and put a new one back in the same place when they had plenty of options to put it on the front of their own house. As the last few posters have stated I am well within my rights to remove it and will be having a 'little chat' with my new neighbors tonight.

    I have a stone fronted house that will need re-pointing in the summer and rendering down the side so I will need scaffolding put up which this eyesore will be in the way of, plus my window cleaner's ladder will be hitting it on a regular basis, so it's in their interests too!

    I will be giving the tenant's, landlord and Sky 7-14 days to remove it or I will remove myself and billing them for my time, just wondering if I could bill them for storage time in my airspace as well if they don't play ball?

    I still dont understand why it is anything to do with Sky.

    Is it a dish used for receiving Sky's services?
    Was it installed by Sky?

    Does removing your neighbours property not put you in danger of some sort of claim from them?

    It is not legal to install something on your house wall which overhangs into your neighbour's. There is a legal distance (someone will know) which should be retained between the two properties, when something is constructed or erected so that for example, you cannot build up right to the boundary wall on your house let alone overhang next door.

    Even with trees you can cut the branches along the boundary wall. That said I would first ask the neighbours to arrange to have it resited as it should not be on your side of the boundary wall.

    Moved in and told the neighbours to move their existing dish! Bet everyone loves you round about...:D

    You don't lease Sky dishes, you own them from day one. It's therefore no concern of the LL or Sky. The dish belongs to the Sky account holder/neighbour.
    No free lunch, and no free laptop ;)
