That is not a compliant letter before claim! They didn't I gather give a popla code on rejection either. You need to respond to this though , go to coupons sticky thread, there is a link onto a thread by Daisy that gives a template to reply to this letter. Make complaints to the bpa and dvla about this, if you've done that already do it againWhen posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. We don't need the following to help you.

Unless I have missed a substantial part of that letter - or one of the previous ones to which it refers fulfils the requirements of the CPR then this is most certainly not a LBA although Devere may believe that it does.My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016).

But they have now refused twice to offer a POPLA code - urgent complaints here to BPA breach of COP and DVLA also the KADOE contract.
so as well as responding to this letter - just the first general one that Daisy does in the thread will do (obviously omitting the legal department stuff )
include in it their failure to offer the ADR by supplying the POPLA code to appeal.0 -

I have now received the following letter (link below) which is claiming to take me and my girlfriend to court should we not reply by the 24th March. Beginning to consider just paying this up, or trying to just pay the initial reduced fee of £60 on each fine.
Just report them to the BPA like everyone else on here does when an appeal is ignored and no POPLA code sent. That is, if your appeal was sent in response to the FIRST letter to keeper about each ticket?
This typical situation is covered in the NEWBIES thread post #6 and on loads of other threads about other PPCs which play the same game. You need your POPLA code and you WILL need a specially written POPLA appeal so don't rush it or use a template without getting info by pm - I would be happy to help you when you get your POPLA code - if you appealed in time.
Devere read this forum and print out threads - but so what, they can still be beaten at POPLA with the right wording IF you appealed the FIRST letters.Hi,

I researched the company, Devere Parking Services, I of course found loads of links and forums ref not paying these rogue companies. So I didn't.
Why would you 'research' but seem to have just read 2012 threads or older archive crap? Advice on here and on pepipoo forum changed in 2013 - and with Devere it was always dodgy to 'ignore' in Bournemouth that I can recall. Nov 24, 2013, tickets issued on two cars on the drive
Feb 2, 2014 Thread started stating "afew weeks ago Devere sent letters asking for £100 per car".
Can we assume Devere got the RK details from DVLC or had you already responded with an appeal to the tickets, from which he got your name and address ?
10 Feb 2014 Devere letter refusing your appeal. ( You have not given us the date or the detail of your appeal and Devere does not refer to the date of your appeal letter in his rejection letter )
10 March 2014 Devere letter threatening he would instigate court proceedings by 24 March. However what letters of yours is he referring to when he states " we will respond accordingly" and what information does he require.
You are now very nearly in the position Devere wants you to be in as far as instigating a court claim is concerned.
He has issued tickets
You have appealed ( we don't know what you said but can we assume POPLA was not mentioned )
He has rejected your appeal
He has sent another letter, awaiting further information but ratcheting up the pressure with a deadline date if you don't respond.
This is in line with Devere's tried and trusted methods and he hasn't mentioned POPLA once. Other posters should remember Devere's extremely dubious methods when they were a private 'entity'. The person behind Devere is making a limited company, that is also a member of the BPA, just about as private an entity as it was before.
4consumerrights says that Devere has twice refused to issue POPLA codes but is it actually the case that Devere has not been asked for a POPLA code and that his current tactics are to operate on the basis that POPLA does not exist?
The other thing the OP should bear in mind is that this is not some random parking event at a retail park, it is on his drive. If he caves in or heaven forbid, loses at court if it gets that far, he could be in for repeated problems. This could be disastrous if it is someone in the block of flats who is 'self ticketing' on Devere's behalf. If you still have the actual tickets, were there Operator No's, ie the person who issued the ticket ?
Perhaps the OP could confirm some of these points and those asked by Coupon Mad in post 25.
Have you checked out the lease or landowner, managing agent agreements relating to 'your' drive ?
For anyone else happening by who is researching Devere, DO NOT IGNORE DEVERE PARKING SERVICES. This doesn't mean pay them, just don't ignore them.0 -
@EHBA - I believe the OP sent a template appeal as on page one and received a response as per post #7 - Devere failed to supply POPLA code.
This prompted the second letter and response.
This needs to be escalated further - complain again to the BPA and DVLA stating that this directly breaches the code of practice and kadoe contract respectively.
Is there a management company here or not (IIRC it is small)I rang the property agents, Foxes and Sons, and they are aware and do have an association with Devere.
Can you confirm if the property in question is rented or leased?
You could consider contacting the local trading standards and or the housing department (the latter especially if rented)0 -

Agreed - be proactive with urgent complaints to the BPA and DVLA about no POPLA code. If Devere get this to a hearing at Bournemouth, for various reasons it's usually a shoo-in for them. So fight for it to go to POPLA instead by complaining now.

They have rejected 2 requests from myself for a POPLA code.
