Devere Parking Services Fine

Hi,
In November I received a parking fine in the windows of both of my cars parked outside the garage to my flat.
I researched the company, Devere Parking Services, I of course found loads of links and forums ref not paying these rogue companies. So I didn't.
A few weeks ago they managed to send letters to my home address now asking for £100 on each car. I have still not responded, the 28 days stated on the letter are getting close.
I do live in the Bournemouth area, which I have seen from other posts is an area they are quite successful.
I have contacted the property landlords, Fox & Sons and they are aware they use Devere as a company.
There are signs up to say no parking outside the garages, these have been there since I moved in 7 years ago however I have always parked just outside my own garage.
What advice is there on what I should do now?
The more I read about their success in Bournemouth the more I'm leaning towards paying and just putting this behind me.
Help.

ps:- its not a fine and never was a fine
its an invoice0 -
Thanks.
Is there a template out there that deals with parking outside flats in front of own garage?
Even though there is clear signage to not park, I believe that is to stop garages being blocked in.0 -
if its your garage and parking space, then you have the right to park there (or if its in your lease) , the signs do not override your rule of ownership or lease terms and conditions
ppc`s make up their own rules, which may be to stop others parking there but dont give them any rights over the leaseholder or landowner
so if you have the right to park there you have the right to peaceful enjoyment and so should complain to the management company and the ppc to stop ticketing your vehicle, if necessary threaten the management company , the landowner and the ppc with court action , others have done so with great effect
in the meantime, they are in the bpa so let popla decide if they dont cancel it
plenty of examples listed in that NEWBIES thread (or links from it) so no idea why you are asking in this thread when its covered in other threads
but here is a typical template to go to your ppc, by stromaDear Devere,
As the registered keeper of (reg) I'm in receipt of your parking invoice xxxxxx dated xxxxxx. I wish to invoke your appeals process as all liability to your company is denied on the following:
1) this charge is not a genuine pre-estimate of loss
2) your signage does not comply with the BPA Code of Practice
3) you do not have the authority or permission to issue invoices at this location
These points and others will be raised with Popla should you not accept this appeal, and you will be expected to provide a full breakdown of of your alleged loss, and your full unredacted contract with the landowner.
If you do reject the challenge and insist upon taking the matter further I must inform you that I may claim my expenses from you. The expenses I may claim are not exhaustive but may include the cost of stamps, envelopes, travel expenses, legal fees, etc. By continuing to pursue me you agree to pay these costs when I prevail.
Please issue your cancellation within 35 days of this letter or supply a popla code to appeal to them.
Any communication that does not either confirm cancellation or include a POPLA verification code shall be reported to the BPA as a breach of their Code of Practice - the BPA recently issued guidance to all members to remind them of this fact. Such communication may also be deemed harassment and pursued accordingly.
Faithfully
and a strong letter to the managing agent should insist its cancelled to
I leave the wording of that letter to your good self, also threaten them with legal action should it continue
so win at popla and cost them £27 plus vat every time they ticket you, then take the to court for harassment , if necessary both the managing agent and the ppc , possibly for trespass too0 -
You will need to keep this thread up to date and should never ignore Devere. Luckily if you send that appeal off quickly as keeper then you will have clawed this to POPLA in time. My other concern is that you need a very strong appeal for POPLA as Devere might win at that stage due to the signage, so:
- please show us a broken link (you can't post full links yet) to a pic of the signs
- please show us that Notice to Keeper (address & refs covered up of course)
- do not respond to any pm from a non-regular poster here...it could be Devere.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

How do I send a broken link?
I have a reply from Devere from my appeal which I want to share with you guys for some advice. They have rejected my appeal.0 -
remove the http://0
-
Did they include a POPLA code with their rejection?
And have you a photograph of signage?0 -
No POPLA code with the letter.
I have photos of the signage but I have no idea how to post things onto here for you guys to see.0 -
use a site like photobucket and put the pics on it, then copy and paste the url for each one but delete the http:// from each url0
