lol ...All ours say dispatch in 3 days and economy deliver 3-5 days. The stuff is always dispatched in one day.

Its not ideal but it minimizes numpties. Sometimes we get a buyer that asks why the 3 day dispatch. We have to explain its to compensate for impatient buyers and all items are dispatched in 1 day

I only do the one day to get the extra 'badge' and discount. If I take a long work contract or am busy I just turn off my shop rather than fail to meet the 1 day. Luckily I am showing 5* for despatch but I find ebay estimates truly irritating.

We always warn sellers to watch time frames- I believe it is 10 days from opening to the point at which it can be escalated. (it might be 7 and I'm sure someone will correct me).

However that time frame is stated, and a seller should never allow the case to be escalated as it counts against them, and you lose your FVFs.

Escalation is the point at which ebay decide one way or the other, it is past the time for negotiation and without tracking you could not win and it will close in a matter of seconds against the seller.

But do Ebay actually read what is said when a case was escalated? I escalated a INAD case and got a refund instantly. This concerned me (even though it was in my favour).

There is nothing to read though is there? The choice is always the same, prove delivery using online tracking or refund- what else can be said?

The escalation is the final event, and the seller cannot possibly win, they will never win unless they have proved delivery

Yes but in my case I did receive the item. My claim was Item not as described. It was arguable either way. I was really shocked that the seller did not have any say.

I'm not blaming him for this. I was pointing out that a tracking no wasn't available because it wasn't offered in the auction, and wasn't requested.

As I said above, I would have been perfectly happy to pay him a refund, on the day we agreed to 'take it from there' (Sat), IF he'd actually got in touch with me on the day we agreed, but from my point of view, he's gone behind my back, and hasn't involved me at the point where he said he would.

What's the "way to phrase it", in your view?

Yes but did you let the BUYER know that you would refund?
Quite important that and from what you say, it sounds like you didn't!
Really can't see why you're so surprised - if, as a buyer, I had got your initial response, I wouldn't have had much hope of a refund aside from one from ebay
I personally think fair enough to point out - nicely - that tracking was not specified in listing but the buyer needs to be told straight away that you are prepared to refund.

... but they didn't ask me anything to 'prove'. They settled the case within one minute of the buyer escalating it, and didn't involve me at all.

Yes they did, the period before it was escalated was when you needed to take action- either refund or prove delivery. Escalation is the final decision- you left it too late.

No, because his words to me had been "I'll give it to Saturday then WE'LL go from there" (my emphasis) - which implied to me that he and I would consult each other on Saturday and review. That didn't suggest to me that he would shut me out, escalate it and effectively go behind my back.

The ebay time frame trumped any private agreement that you and buyer made between you. As long as buyer kept the case open the clock was ticking.

Your going round in circles - they did give you a chance and you did not take it.

I doubt anyone from Ebay/Paypal even read it. As soon as it was escalated - Ebays computers will have checked for tracking and then refunded.

Once a case is open - its past the estimated delivery time - and you have to stick to Ebays case timetable.

I refund one day before they have to a chance to escalate. That gives just the bit of extra time needed. It aslo prevents a strike from Ebay.

Ebay no-longer let you see any strikes / policy violations. But trust me - you got a strike.
