Can we not even buy a pair of shoes now without blaming someone else?

This is consumer rights not consumer wrongs.

Would you not agree that someone has a right to a refund when mis-sold an item?

You were not mis-sold a pair of shoes. You took a chance with a pair of shoes you knew were uncomfortable, some shoes give to fit the feet and some don't. Get them on Ebay because i can't see you getting your money back from Soletrader.

Oh come on, everybody knows a lot of shoes need broken in, you weren't mis sold anything.

They were uncomfortable, you bought them any way. You only have yourself to blame.

a podiatrist once told me that if you have to "break shoes in" then they are the wrong size

Ive always been told to wear new shoes indoors to try them out, see if they are comfortable and decide whether I keep them or return them.

    Good idea that!

Wish I had tried that when I bought my last pair...tried them out for 4 weeks but the 'bed' on the toe was actually sticking into my foot (folded at a bad angle). Went back a few weeks later, explained the problem, they took them back and gave me a fresh new pair. You don't get service like that often.

Because they were faulty, not just ill-fitting :)

But are salespeople in shoe shops considered 'experts'?

    I wouldn't say so.
    Nor me

I would always assume that salespeople (of any kind, not just shoes) either have sales targets to meet or are working on commission

  • I wouldn't have bought the shoes if not for the advice of the sales person. Simple as that.

I don't think it was unreasonable to assume that he knew more about the specific shoes than me.

To be honest I'm quite surprised at some of the harsh/unhelpful responses, I thought the ethos of this site was helping people the small people beat the big dogs.

There are parts of the Sale of Goods Act relating to this, I've read and been taught them, too long ago to remember specifically sadly. I started this thread only to see if anyone actually knew the specific sections of the act which applied.
