In January 2010 then in theory she could have claimed I.S and added you as a partner,
You may not of known about this option at the time and you weren't told by the department about it.
After January 2012 this wasn't an option as new claims to I.S couldn't be made on the condition of entitlement of IB credits.

yes i have been in touch with cab and they are helping. ive also logged a complaint with dwp saying that i have been both misinformed and wronged by jobseeker advisors that dont know there job properly.0

Decisions on benefit are not made in job centres, they are dealt with at the relevant benefit processing centre for the area. Reason being as benefit rules are complex.
They no longer give benefit training to the job centre staff - so if you have queries on what you can/can't claim- then contact the correct department- 0845 600 1651

well they should give them training as it was them that told me on lots occasions that me and my partner could not have IS, if they would have had the relevant training none of this would be happening to us.0

yes i did i asked about IS and JSA i was told i could only claim JSA.
also asked a handful of times during my claim
the answer may lie here,
you could only claim JSA at this point, your wife however could have claimed I.S and added you as the partner.
Where they aware that she had IB credits?, did you declare it on your JSA claim form at the time ?
You need to SAR them and find out what you declared.
This may add some weight, but it will still be a battle as the onus is on the customer to check what benefit they should be on or may be entitled to..0 -

They keep it separate so that the relevant depts deal with their own queries. Eg: the benefit centre won't deal with queries for people claiming a Benefit who has a question about an interview with an adviser in the jobcentre, and vice versaPlease be nice to all moneysavers!

i understand what you are telling me, but i will go with what cab have said, basically when i asked my advisors at the jobcentre if me and my partner(not just me) could go onto IS they gave me a flat NO!!! if they knew their way around the benefits they would of not said this they would have looked into it. so therefore their lack of training has left them being negligent no fault of there own, down to there employers the DWP.0

i would like to thank all of you for your comments and give a little update.........so far jobseeker have admitted they were wrong and i was misinformed and misguided, and claimed that me and my partner should of been receiving IS with disability premiums on top. that there own system should of never allowed this to happen as you cannot claim IB and jsa at the same time. (this is what an adviser told me)
this has now been passed to a resolution team to see whether or not they can back date these payments.
i hope they can as the next stage is tribunals, court proceedings!
should i ask for compensation as well?0 -
